Legislature erupts in chaos, the KMT still sucks, and the spark of fresh resistance

First, I just want to acknowledge that I haven't been blogging very much. I know. I've had other writing projects, but beyond that work is both a challenge and a treadmill. By that I mean it both requires creative energy (fantastic) but also feels a bit insurmountable (not fantastic). At least I'm happy with where I am career-wise, which I wouldn't have said six months ago. 

I felt a bit knocked out of my blogging stupor on Friday, when a fight broke out in the Legislative Yuan over a proposed bill to expand the powers of said legislature. Not only is the bill deeply undemocratic, but the method by which the majority coalition -- they wouldn't call themselves a coalition, but they effectively are one -- attempted to pass it. 

The sum of it: the KMT, with the TPP as their lapdogs, are trying to pass a bill that would require the president to give an address before the Legislature every year, and be subject to immediate questioning after. More chillingly, it would expand the legislature's ability to conduct investigations -- they already have some authority, such as access to documents -- and introduce the concept of "contempt of the Legislature" which would work like this 

Those who refuse a demand by the Legislature or delay in responding, conceal information, or provide false statements to the Legislature during an investigation, inquiry, or hearing or when it reviews documents can be fined or, if serious, seen as "contempt of the legislature," according to the KMT lawmakers' bill. 

This would be a criminal offense, and refusing to appear or accused of lying to the Legislature would be punishable by fines or jail time. Those required to comply would not only be government entities, but private ones as well. 

The issues, legal scholars and others note, is that it's not clear where that power begins and ends. For example

Lin Chih-chieh (林志潔), a legal professor and a DPP legislative candidate in the January election, warned at a public hearing that if the bills passed, the Legislative Yuan would be able to demand the presence of, for example, TSMC founder Morris Chang (張忠謀) and accuse him of contempt of the Legislature if he refused to attend.

The Legislature could also ask TSMC or other enterprises to provide sensitive information related to their commercial secrets, Lin argued.

What's more, what constitutes "lying", "delay in responding" or "concealing information" is not particularly clear. How it will be determined that someone called to testify has done these things is not, as far as I know, defined in any known way. The problem here should be obvious: with no clear, impartial mechanism to determine what constitutes a delay, a lie or concealment, who's to say what might be called, for example, a "lie".  Anyone can insist anyone testifying has "lied", threatening criminal punishment, and it's extremely unclear how that power might be wielded fairly. 

People whose testimony (or lack thereof) dissatisfies legislators -- again, this whole thing should chill you to the bone -- can be sent to court 'to impose a sentence' (it's unclear whether the court can overturn the legislators' decision). In other words

Furthermore, how contempt of the Legislature is determined, by whom, and the criminal elements of contempt of the Legislature are not explicitly stated in the KMT proposal. Critics believe that if the legislator does not like the content of the official's answer to the question, does not like their attitude, or "interrupts" the official who is answering the legislator's question...under a loose determination, it may be possible that legislators will use their own subjective desires to imprison the official under questioning through court resolutions.

Does this remind you of any other period in Taiwan's history? Perhaps a period of several decades, under which the government could pull you in for questioning and jail you if they didn't like your answers, using ill-defined powers with essentially no oversight? 

I don't think that the Legislative Yuan is going to start mass murdering dissenters or anything like that, but if this doesn't give you Big White Terror Energy...it should.

This lack of clarity seems very much by design: the bill bypassed a line-by-line reading as well as an article-by-article discussion, and according to Initium Media, all versions of the bill from the KMT and TPP were sent to committee while all DPP versions and proposals were blocked. Laws in Taiwan have a period of discussion (sometimes called 'freezing') where parties are meant to negotiate and come to a consensus on new legislation, which is between one and four months -- four months is the norm, but the 'freezing' of some crucial legislation may be shorter. In that period, the KMT refused to engage in any substantive negotiation or discussion with the DPP on this bill.

Because there was no line-by-line reading, and all versions were sent to committee (if I'm reading this correctly), it's unclear which version would have passed the vote on Friday. Not all versions are available publicly, in fact, I'm not even sure if the legislators themselves know what's in the bill. This is very wrong: in general, new legislation under consideration should be publicly available, discussed in detail by lawmakers, and the final version that goes to a vote known. 

It's also worrying that how the bill would play out against previous Constitutional Court rulings, specifically ruling #585, which states that the Legislative Yuan has the power to conduct investigations related to its own functioning but not beyond that: 

Under the principles of separation of powers and checks and balances, the scope of the targets or matters subject to the Legislative Yuan’s investigative power does not grow unchecked. The matters to be investigated by the Legislative Yuan must be substantially related to the exercise of its powers under the Constitution. And, in addition, whenever a matter is related to the independent exercise of powers by an organ of the State that is guaranteed by the Constitution, the Legislative Yuan may not extend its investigative power to such a matter.

This interpretation already gives the Legislative Yuan the power to 'compel' testimony on matters under its jurisdiction, but it's unclear if attaching criminal penalties to this would be within the scope of the interpretation. In addition, unlike other countries that have contempt of Congress or Parliament laws, Taiwan already has an investigative body, the Control Yuan.

This body is in charge of impeachment, censure and audit. If they already have the power to investigate government officials, why exactly does the Legislative Yuan also need this power? Indeed, according to Interpretation #585 above, to take that power might well interfere with the "independent exercise" of the Control Yuan, making it unconstitutional. 

Of course, we don't know exactly which powers this will grand the Legislature and whether they step on the Control Yuan's toes, because we don't know what's in the bill! Even the Taipei Bar Association has weighed in with concerns about the bill. It's Bad News Bears, you guys, 

It's pretty clear that the goal of the legislators is to increase their own power during a term when the KMT has a legislative plurality, but the DPP has the presidency. It's not about punishing those who lie -- KMT legislators lie all the time -- and not really about filling a much-needed gap in the government's ability to function, as there's an investigative body that already does this. In other words, it's exactly what critics have called it: a power grab.

If this seems reminiscent to you of some of the black box politics characteristic of the Ma Ying-jeou era, that's because it is. The same sort of 'let's push this through and not make it entirely clear what the legislation entails' is the exact sort of authoritarian bullshit attitude that helped spark the Sunflower Movement in 2014. While the details differ, broadly speaking, the strategy feels quite similar to the attempted passage of the Cross-Strait Services and Trade Agreement (CSSTA or 服貿) in that year. 

With the KMT more or less back in power in the Legislative Yuan, it's not surprising that they are exactly who they've always been. 

Friday was voting day for the bill, and anyone could have predicted that fights over it would break out in the Legislature. Again according to Initium Media, the clause requiring the president to address the Legislative Yuan and then answer questions (which is somewhat unprecedented in ROC history) was passed by a show of hands -- meaning the names of those voting for and against were not recorded as is custom -- but due to the physical altercations, all other parts of the bill have yet to be dealt with. 

I'm not sure exactly why, but the violence in the Legislative Yuan on Friday somehow seemed more serious, or touched a deeper nerve, than scuffles I've read about previously. To me, the three most notable instances of scuffles or outright violence were DPP Legislator Kuo Kuo-wen (郭國文) grabbing the documents and sprinting out of the legislative chamber with them, which, to be clear, that guy rules.

Chung Chia-pin (鍾佳濱) of the DPP tackled the KMT's Chen Ching-hui (陳菁徽) while both were on the podium; Chung claims he slipped on a piece of paper, and from the video evidence, that seems likely. Notably, in some reports, pan-blue mouthpiece TVBS, despite offering a pretty awesome metal-lite background to the footage, seems to have edited out the part where Chung fell. 

Finally, DPP Legislator, democracy activist and founder of Doublethink Lab Puma Shen (沈伯洋) was  pushed off the rostrum and landed on his head. Shen was hospitalized along with five other lawmakers, though his condition at the time appeared to be the most severe. 


As of today, Shen appears to be in recovery -- or at least, he's conscious -- telling the public that the TPP's three-point statement on the issue is, essentially, three lies, and that they are the ones in "contempt of the Legislature". 

According to CNA, the TPP claims that only some reforms were on the agenda for that day, and the "contempt of the Legislature" was not. I'm honestly unclear on this point, but Shen claims it's wrong. Second, the TPP claims that the DPP either "didn't understand" the timing of the discussions, or put forward excessive motions to adjourn so no discussions could take place. Shen counters that in truth, the DPP called for adjournments because the KMT and TPP wouldn't discuss the bill, and accuses them of confiscating or dismissing DPP proposals, so what could the DPP do but resist the process? Finally, the TPP claimed that the 'show of hands' method of voting is a legal and recognized method. Shen points out that the vote counts are still unclear as a result -- some of them don't match up -- and as the tools to register names of who voted for what were available, intentionally not using them is not a good method. 

For anyone thinking "well that's just majority party strategy", the DPP as far as I can remember never did this to the KMT in eight years of having control.

In the aftermath, the DPP's Chung has apologized to Chen (the woman who was tackled), and clarified that he was also in pain from the fall. The KMT, as far as I can tell, has not apologized for injuring Shen or anyone else, with caucus whip Fu Kun-chi daring the DPP to sue the KMT over their actions

Not to get too biased or anything, but that corrupt sex pest really is a massive wet sack of steamy garbage juice.

Fu has also called the DPP "thuggish", despite arguably the worst injury being sustained by a DPP legislator. That's to be expected, though, the KMT loves characterizing the DPP as ignorant rednecks who could not possibly wield power with the grace and authority of the educated KMT. It's a also a time-honored tactic around the world used to discredit activist movements. Want to turn the public against a group? Call them thugs!

Of course, the DPP weren't the ones who terrorized Taiwan for decades under the White Terror and Martial Law dictatorship like thugs.

Speaking of the old dictatorship, the KMT also accused the DPP of being "used to monopolizing power". Hmm, let's review: which party imposed decades of Martial Law so heinous that it made the Japanese colonial era look like a paradise in comparison? Sent dissidents to Green Island, tortured them and killed them, claiming they were all "communists" (not all were, and regardless it shouldn't have been a crime in the first place)? Engaged in mass killing sprees after 228? Let the dictator's son run the secret police, deciding more or less on personal whims who lived and who died? 

Which party ruled Taiwan with violence for so long, and so horribly, that the people started organizing to force it to end? Which party's crimes against the people are now memorialized in prisons-turned-museums on Green Island and in New Taipei? Was that the DPP?

Which party, out of approximately thirty years of democratization, has held a majority in the Legislature for twenty of them (so, about two-thirds), even when the opposition had the presidency? Was that the DPP? Which party engaged in legislative chicanery so preposterous that a bunch of students occupied thei chamber and rallied many, if not most, Taiwanese to their cause? Which party's president is leaving office with unprecedented popularity, as opposed to her KMT predecessor who wishes he could have hit double digits?

So, which party again can we perhaps accuse of trying to monopolize power? Because it sure as hell doesn't look like the DPP.

With the inauguration tomorrow and fresh deliberations over the bill set for the day after, it's unclear what's next. I have noticed, though, that with the old KMT tactics of black-boxing their trash and calling the DPP "thuggish" for resisting, that perhaps a spark of that old civil disobedience is coming back. 

It's not that protests simply stopped after Tsai took office. There's been a Panay Kusui-led protest encampment in 228 Park for a very long time, focused on Indigenous land rights. There's a laor protest more or less every year, though they don't have much staying power. There were the marriage equality rallies. 

But it sure does feel like civil society has gone somewhat quiet in these years. I don't think I've attended a protest/rally since marriage equality (though, to be clear, my health took a tumble during the pandemic as my career picked up, so often I just haven't got the time). Many have commented that younger Taiwanese, now almost a generation removed from the Wild Strawberries and Sunflowers, and two generations from the Wild Lilies, don't seem to have that same activist spirit, aren't worried about China (and thus care less about the KMT's foreign policy of basically selling out Taiwan) or aren't the angry young protesters who helped bring Tsai to power in 2016 -- in fact, they're not necessarily enamored with the DPP at all

On the one hand, I've kind of noticed this, too. The desire to go out there and fight for something better hasn't seemed as alive of late. Perhaps it's because President Tsai, unlike her predecessor, actually did a good job leading Taiwan -- and I do think, with some criticisms and imperfections, that she did. Perhaps they're just used to the DPP being 'in power', and the people with the power are usually not the ones that inspire the youth. 

But now KMT avarice is laid bare once again, which was always going to happen once they were given national-level power again. I'm not sure why so many people didn't see it coming, and while it's certainly not a good thing, maybe the old fire will come back. Maybe the next generation will see once again what utter rapacious dipshits their parents voted for, and stand for something better. 

Spontaneous protests broke out outside the Legislative Yuan on Friday night, and on Saturday Internet celebrity and commentator Four-Pronged Cat (四叉貓), known for infiltrating and subverting KMT protests, held a "pilgrimage" to the street below the home of KMT legislator Hsu Chiao-hsin (徐巧芯). She's the one who pulled out a musical instrument during the fighting and played the ROC national anthem -- honestly, don't ask. Apparently, people passing Hsu's house deemed to be protesters had been interrogated or otherwise documented by police, which frankly feels quite undemocratic. For a small-scale action, it's still impressive that, apparently, hundreds of people showed up. 

These are small numbers by the Taiwan protest standards I'm used to, but it feels like a step in the right direction as we head into the unknown territory of a third-term DPP presidency, and a KMT-led legislature that seems more cupidinous than ever. We're going to need that vim and vigor from everyone, not just Gen Z Taiwanese, to do something about it.

Chillin with 120,000 of my people at the big DPP rally

I usually only go to one big rally per election season, because the big ones are exhausting. It can be hard to leave depending on where you are, so attending may be a real commitment. If I get the chance I might seek out some local rallies for legislative candidates, because I can bail at any time. The presidential ones, though? I know people who rally-hop, but I don't have the energy for it.

This year, I picked the big DPP rally on Ketagalan Boulevard, just two days before the election. Ko Wen-je's TPP rally will be held there tomorrow, I believe -- I'm not sure if they just happened to snag that date, or if the ruling party is being sporting in letting someone else (who is unlikely to win) have the big downtown venue the night before the race. 

Speakers at the rally estimated the crowd at around 120,000, and that seemed accurate. It was impossible to reach Ketagalan Boulevard itself by 6:30pm; I was somewhere on the circle around Jingfu Gate. It was a pleasure being around people with similar politics; I live in a very dark blue area and while I appreciate being confronted with other perspectives, it can also be tiring.

It had all the bells and whistles one can expect from a rally...literally. Candidates speak and then the crowd is led in a chant for their election ("凍蒜!"). The music is carefully orchestrated to follow the tone of whatever's being said; I'm not sure if it's all carefully timed beforehand, or if they have a DJ who switches up the generic cinematic orchestral background depending on whether the audience is meant to be energized, touched, furious or elated.

I did notice they used the same sequence of villainous chords whenever a speaker mentioned Chiang Kai-shek, Ma Ying-jeou, Xi Jinping or Han Kuo-yu. Each one of them, I suppose, is just a different version of Darth Vader.

Actual presidential candidate Hou Yu-ih was barely mentioned, if he came up at all. I'm not sure if the thought process was to (mostly) refrain from attacking direct opponents to focus on the DPP's achievements over the past 8 years, if they don't see Hou personally as much of a threat, or if people like Ma have made themselves easier bait from dumbass comments they've made recently. Ma, famously, gave an English-language interview in which he said that Taiwanese should "trust" Xi Jinping. The "trust" comment has been setting the news cycle on fire, but I found his comments that "unification...is acceptable to Taiwan" because it's what "the constitution says", and that Taiwanese people "might be interested" in peaceful, democratic unification (they are not, but perhaps Ma has been unwisely reading too much Bonnie Glaser).

The idea that because the Republic of China constitution can be interpreted that way -- an interpretation I happen to think is inaccurate -- that unification is therefore "acceptable" to Taiwan is a total dismissal of what Taiwanese people actually want. No wonder just about everyone on stage Thursday night used Ma as a rhetorical punching bag. Even KMT candidates don't seem too pleased about Ma running his big stupid mouth

Giving Ma a thorough thrashing constituted most of the 'negative' talk, with the exception of former premier Su Chen-chang 蘇貞昌, who played the role of attack dog for the night. He's very good at it.

The rally began with a full slate of Taipei city legislative candidates, including Hsieh Pei-fen 謝佩芬, Kao Chia-yu 高嘉瑜, Wang Shih-chien 王世堅 and my personal favorite, Miao Po-ya 苗博雅. A quick run-down: Hsieh has impressive academic chops, ran a losing race in Da'an against Lin Yi-hua, and is now running in Zhongshan/North Songshan. Kao was the youngest sitting member of the National Assembly back in the early 2000s and served on the Taipei City Council. She's known for being frequently in the media (or a target of the media), and is running in Nangang/Neihu. Wang gave a bombastic speech in Taiwanese; he's a former legislator turned city councilor, running in Datong (where he is also from; his grandfather and father were killed in 228 and arrested during the White Terror, respectively). Wang is famous for making weird bets that he always makes good on, and for apparently looking like Chucky. 

Miao got the biggest response from the crowd: they absolutely went nuts for her. I'm not surprised: she helped turn the unwinnable Da'an/Wenshan legislative seat into a fiercely competitive race. I've stanned her since before most people had heard of her, and now I stan her even more. I'm hoping to talk more about Miao tomorrow, before the moratorium on election talk, but suffice it to say, she's fantastic.

The DPP focused on its successes, with both former vice president Chen Chien-jen 陳建仁 and health minister Chen Shi-chung 陳時中, who lost the Taipei mayoral race, talk about Taiwan's world-class pandemic response. Gender and marriage equality also featured, with lots of rainbow flags among the pink and green campaign flags. Party list legislative candidate Chen Jun-han 陳俊翰, who is both a lawyer and disabled, gave a touching speech about how his disability has helped him see the value of life, and that he chose to accept the call from the DPP because he believes Lai Ching-te will build a "just" and "warm" Taiwan. 

Much of the rest of the rally was about linking Lai to Tsai -- essentially, a vote for Lai is a vote for four more years of Tsai, or at least Diet Tsai (my words, not theirs). Fire EX performed Child of Taiwan (Tai-oân Kin-á), which has a direct musical link to their hit Island Sunrise 島嶼天光 and Stand Up Like A Taiwanese, which I believe references a line from Chthonic's Supreme Pain for the Tyrant. Speakers emphasized Taiwan's comparatively progressive society in Asia, how it leads Asia and even the world in freedom and democracy, and is not an "orphan of Asia".

The idea? It's not so much about beating the other guy, but that a vote for the DPP is a vote for Taiwan. That said, the content of a commercial showing all of Taiwan's progress regressing under a KMT presidency, complete with a scary campaign poster reminscent of Han Kuo-yu, was referenced frequently. If a vote for the DPP is a step forward, the logic goes, a vote for the KMT is a step back. Protesters back on the street, Sunflowers back in our hands. (I can't find a video of the commercial in question, but if I do I'll link it).

Basically, if the KMT is trying to appeal to its own base by running people like Jaw Shao-kang 趙少康(honestly don't even ask me what his preferred spelling is) and Han Kuo-yu to turn out the reactionaries, the DPP is leaning into the "progressive" part of the party's name, or at least the promise of it. 

One could say that they're the more positive and optimistic party, as the KMT seems to mostly be in attack mode. That might not be entirely fair, however. It's a lot easier for incumbents to highlight their successes, if indeed they had successes (and the DPP has). 

The fact that Lai is essentially running on Tsai's record shows not only that even though Tsai Ing-wen may no longer be at the height of her popularity, she's still more popular than previous outgoing presidents Ma and Chen. The DPP feels public faith in their tenure is strong enough to run on; maybe it will work, maybe it won't, but it's telling that they don't have to distance themselves from that record.

A combination of Lai Ching-te and Hsiao Bi-khim's names (美德, which means 'virtue') was frequently referenced, along with campaign slogans "choose the right people, take the right path" (選對的人,走對的路) and Team Taiwan (挺台灣), which comes with a whole sports theme.

President Tsai spoke toward the end, saying she realized that many young people felt she didn't do enough. She acknowledged that but pointed out that every step was a step forward. Hsiao Bi-khim re-iterated many of the previous points, adding that she was appreciative of all the female voices in the DPP and among its supporters, calling herself a "proud Taiwanese girl" (echoing the Fire EX song). Hsiao noted that despite Taiwan's difficult history, the world can now see that Taiwanese people don't give up.

She also mentioned a minister in Pingtung? I'm not really sure, but it was the first time I've actually heard a word from my Taiwanese class (bok-su, or minister) used in the real world. So, that's cool. 

To be honest, I had a metal screw drilled into my jaw on Monday and hadn't had painkillers since lunch, so I started to lose the plot by the time the big candidates took the stage. 

I'm beginning to lose the plot again now, so I'll leave it there.

A bunch of bad eggs

This big snake covered in money lives in a Burmese temple, but it's what I picture when I think of the KMT.


Imagine spending three weeks traveling in the US and Canada -- San Francisco, Las Vegas (for a wedding), the Grand Canyon, Portland, Seattle, Vancouver and Victoria -- complete with a break from Taiwanese current events, simply because maintaining good health requires lots of breaks. 

Then you return only to see memes and cartoons of the Minister of Agriculture on Facebook. No government job strikes you as less glamorous, but here we are, all because "a number of controversies" popped up about an egg import scheme the government enacted during the Great Egg Shortage of early 2023, and the subsequent resignation of Minister Chen Chi-chung (陳吉仲).

As a newly-minted diabetic who was diagnosed just as the Great Egg Shortage was ramping up, eggs became both a cornerstone of your diet, and also the bane of your existence; they were nearly impossible to find. 

That's where I was coming from with all this, and I still struggled to care. It had the whiff of a bogus controversy propped up by exaggerated creative storytelling. 

After looking into it, it still reads as a big fat nothing-omelet. I'd like to talk about why, with a quick caveat: I've done a lot of reading, but I'm still extraordinarily jetlagged and honestly, can't be particularly arsed. So a lot of this is just my opinion in an intentionally casual tone, with maybe some links sprinkled in if my arse decides to...arse. I'm only really writing about it because it's a good example of what happens when the important opposition function of keeping the ruling party accountable devolves into any ol' random attack. Besides, as above, I care about eggs perhaps a little bit more than most people. 

Most English-language news doesn't offer much in the way of actually describing the "various controversies", and the Mandarin-language news is breathlessly reporting all sorts of bullshit, so it took awhile to find anything meaningful.

The Taipei Times points out that a large number of the egg imports expired and had to be destroyed as domestic supply stabilized, and the subsequent waste totaled about US$6.25 million. (TaiwanPlus attributed that number to the total cost of the import project). Other eggs had to be destroyed as the wrong expiration date was printed on them, but the total number doesn't seem to be very high, and no expired eggs were sold to the public. 

Some questioned the nature of a company who got the import contract -- apparently they're new and don't have a lot of capital -- implying there was corruption afoot without actually saying so, probably due to lack of evidence. There's (frankly insane) insinuations that "maybe" there is a "money issue", again with no proof or even a hint that such proof might exist. Others are calling Chen "Tsai's Boy".

One KMT legislator accused the DPP of waiting to designate Brazil as a bird flu outbreak zone, but those familiar with the imports noted that the eggs in question left Taiwan before the outbreak began. 

None of this seems like a particularly big deal to me. US$6 million sounds like a lot, but on the scale of government budgets it's not really. Nobody bought, ate or got sick from expired eggs. 20,000 mislabeled eggs is unfortunate, but it still just...doesn't sound like a lot? Big recalls are often much, much more sweeping than that.

Even pan-green media are publishing opinion pieces admitting that the issue isn't "about the truth of the egg import turmoil", saying Chen was right to step down as an issue of "ministerial integrity". How, exactly, Chen lacks "integrity" is not explained -- and I can't see that he indeed lacks it. The writer cobbled this (non) issue together with a previous thesis plagiarism scandal by an entirely different person, but I don't see how they're related. One is actually a breach of public trust. Importing eggs and having some of them go bad isn't. 

From a political perspective, stepping down was probably the right move in an election year, but not because he did anything wrong. This is just...what happens when a furor is made -- manufactured, really -- right before an election. I don't think it's anything more complicated than that. 

And yet, it's all over the news. The public is mostly dissatisfied over the government's handling of the whole thing, but I honestly can't find anything to be that upset about. In fact, nobody seemed that dissatisfied when the imports started flowing in and eggs became available again. I, for one, was overjoyed! There are very few foods I can stomach for breakfast that won't spike my blood sugar; without eggs, I didn't really have other good options.

I know Taiwanese voters have very high expectations, resulting in satisfaction rates that seem low by any other standard, but come on.

So here's my extremely biased (but to my mind accurate) take on the whole thing. The KMT would desperately like for there to be a real scandal to take down the DPP. They'd love it if the DPP actually took a major misstep or two. There are even things they could say about Tsai's tenure that I'm not entirely happy with either. Low wages and lack of paid time off for Taiwanese workers, a failure to meaningfully address Taiwan's increasingly broken water and energy systems, lack of sufficient forward movement on migrant exploitation -- and that's just off the top of my head. Knowing they can't promise to do any better and the public likely won't be whipped up into a frenzy over them, however, the KMT leaves those alone and goes for eggs.

After all, a great way to get a lot of Taiwanese voters angry very quickly is to imply there's something dangerous about the food supply. It never fails. 

Nevermind that the DPP has pledged to subsidize improvements in hatcheries to circumvent future potential shortages, something the KMT never seems to have done after past shortages have sounded warning bells about the state of the domestic egg industry. (If I'm wrong about this and the KMT has actually tried to help farmers upgrade their equipment, let me know, but I don't recall this ever being addressed). 

When a party acts as the opposition -- something the KMT never learned how to properly do -- their chief mandate is to hold the ruling party accountable. I haven't seen the KMT actually do this. Where is the push for better energy and water supply solutions? Where is the push for stronger defense forces? Where is the push for pay, working conditions and affordable housing that will encourage people to start families, along with improved immigration procedures as Taiwan's population ages? Where is the push for an improved social safety net?

Oh yeah, right, the KMT doesn't actually care about any of that. Energy doesn't matter because they just want nuclear -- but don't care enough to build public trust that the plants are safe, or safer plants with waste storage solutions that don't infringe on Indigenous land rights. They don't care about water, because...well, I don't know why but this issue is pretty fundamental so I assume it's because they don't care about Taiwan. They don't care about birthrates because they fundamentally don't understand why people aren't having children (I've heard discussions of this on talk shows and it's always some inane bullshit about 'kids these days' -- no, idiots, people need enough money and a good place to fucking live). They don't care about defense or stopping information warfare or cybersecurity because they want Taiwan to be subjugated by China.

So they turn to eggs, and take a non-issue to stir up some fucking bullshit election "controversy", pushing a good man to step down and falsely causing their base to believe there's some sort of scary danger in the food supply when there was none. Failing that, the most famously corrupt party in Taiwan's history implies DPP corruption without proof.

Not that the DPP doesn't have corruption -- of course it does -- but probably not in this specific instance.

And now egg prices are rising again. I've also noticed fewer eggs available at grocery stores -- great. What the hell does the KMT suggest be done about it? Nothing, it seems. 

And what else was the DPP supposed to do about the egg shortage? Just let prices remain high and eggs scarce? Taiwan apparently eats 20 million eggs a day -- I can't remember which media reported that number, but it's in one of the links above. That's almost one egg per person. They're important to the Taiwanese diet, and it makes sense to import when domestic production is adversely affected.

It's like the Medigen "controversy" all over again. Imply there was some corrupt dealing around imported vaccines, with no real proof. Then imply Medigen doesn't work (it does). Then imply that vaccines, not COVID itself, are the real danger (wrong, and dangerous). Then COVID waves continue to roll in and we're not as prepared as we could be. 

All because of a few bad eggs.

A Paucity of “Blessings”: the KMT and what it means to be “credible opposition”

It’s rare that I have not a single critical thing to say about the overall body of work of an expert or policy wonk focusing on Taiwan. However, a few people come close, and I’ve always admired the work of Kharis Templeman. He’s good at what he does, he’s clear and to the point, and he makes sense. I’ve never heard him say anything ridiculous about the US or Taiwan “provoking” China, among other claims I personally think are, well, deranged. He seems sensible. I’m on board.

So, I would like to begin this post by stating that all of it comes from a place of respect. I read his forthcoming “Blessings in Disguise: How Authoritarian Legacies and the China Factor Have Strengthened Democracy in Taiwan” and, well…to put it kindly, I was not entirely impressed. To be clear, most of the argumentation makes sense, and he doesn’t make any historical slips that I could find (you’d be surprised how often that happens with other scholars and researchers). 


That said, I have thoughts. I do think Taiwan needs at least two credible, stable, institutionalized parties. The DPP needs a strong rival to hold it accountable, and vice versa -- the DPP needs to hold its opposition accountable, as well. That other party is, and always has been, the KMT.

However, I see no reason why that strong opposition should necessarily continue to be the KMT. After reading Templeman's paper...

...I still don't. 


The core thesis is that the KMT is “good for Taiwanese democracy” by existing as an entrenched, institutionalized party with a core voting base and ability to govern within established systemic norms. 


This does make sense on its face: stability begets stability, and democracy is tied deeply enough to the will of the people that if there are not institutional factors at play, including disciplined, electable yet competitive parties, it’s easy for the whole thing to fall apart. It’s frightening how quickly one party might gain a stranglehold on power, or for the system to become so chaotic or unaccountable that it’s not clear what benefit ‘electing your leaders’ even has. 


Here's the thing, though: it’s just a little too close to ‘status quo for the sake of the status quo’ — what we have now is good because it’s stable, and change is to some extent inherently destabilizing. To be honest, there may be some truth to that. Not all change is good; even in the most flawed system, change can bring unfortunate consequences. 


But, as we’ve seen with Taiwan’s own democratic transition, change may be scary, chaotic and raw, and still need to happen. 


The DPP were once the outsiders, the upstarts, the ‘anti-system message’ guys. And now they’re institutionalized. 


In other words, upending the system, letting in newcomers and outsiders, destabilizing norms — these can be terrifying and have negative consequences alongside the positives. But a party may well only be an outsider or destabilizer…until it isn’t.

And a party may be a credible institutionalized rival...until it isn't


Thus, the argument that the KMT is good for Taiwan only holds for as long as they actually do have a strong voting base. It’s true only insofar as they remain competitive and can actually win every kind of election. That’s not assured: they can and do dominate at the local level, but nationally, their ability to actually win an election is, well, up for debate. At least for now. 


The second they lose their legitimacy, their base, their electability (especially at the national level), what then? Are they still “good for democracy” if they can’t provide a reasonable alternative to the DPP? I wouldn’t think so. 


Right now, the TPP, no matter how unclear their policies, seems to be presenting a credible threat to the KMT and is becoming truly competitive against the DPP. They’re “outsiders” now, but perhaps less so with an erstwhile Taipei mayoralty under their belt. They are already both in leadership and hot water in Hsinchu (corruption allegations), and Ko is giving the KMT's Hou a solid scare in the presidential race. 


What if the TPP actually makes it and becomes “institutionalized”? Will we need the KMT then? Or are they only a “blessing” for Taiwan as long as they’re credible? If the TPP actually does usurp the KMT’s competitiveness against the DPP, I wouldn’t necessarily say it’s good or bad — just different, and indicative of how far the KMT would have fallen. Certainly not a loss of any ‘blessing’ stemming from the authoritarian era. 


It makes sense that stable political parties that respect the norms of governance and remain competitive are good for democracy in general. As long as the KMT and DPP fit this bill but no other parties do, I can understand the argument. However, the moment another party becomes ‘institutionalized’ — credible, prosperous, competitive — what exactly is the benefit of the KMT in particular? Why should it be them specifically?


Templeman tries to make the argument that the KMT itself is “indispensable” as the opposition to the DPP, but this is where I found the paper weakest. 


Again, it is only ‘indispensable’ for as long as it remains stable, credible and competitive. And outsiders are only outsiders until they’re inside — like, oh, the DPP. And insiders only remain inside for as long as they can hold their place. On those fronts, Templeman seems more optimistic about the KMT’s future at the national level than I am. 


Let’s look a little deeper at the two points made here: one is that the KMT’s own disciplined party core forced the opposition, which lacked the KMT’s resources and institutional entrenchment, to also create a disciplined, organized hierarchy that (ironically, as he correctly notes) this meant that the DPP’s organizational structures mimicked the KMT, both of which are founded, basically, on Leninist norms of party structure. 


This is an accurate telling of history, but whether it’s a “blessing” depends on whether you think that particular party structure is ideal, or a good choice. I’m not an expert in Leninist party structures, so I’ll save that question for someone else, but in general I am not a fan of Leninist praxis. I do wonder if Taiwanese parties could perhaps do better than the model they were handed. 


I doubt the DPP is going anywhere, seeing as they hold both the presidency and the lead in the  upcoming election (keeping in mind that a lead this early on is not always easily kept). Furthermore, their general orientation regarding Taiwan’s sovereignty is much more in line with the general consensus. Whether or not Taiwan should — or even can — have “better relations” with Beijing is still up for debate, though I tend to think Beijing’s own attitude makes that impossible, not any specific policies of the DPP or KMT. However, on unification vs. independence and national identity, the DPP seems to be much closer to what a greater share of the electorate wants


As for the KMT? Well, would it be so bad if a party that was disciplined but had a novel party structure that didn’t follow the old China-imported Leninist paradigm usurped their position as chief competitor? Crucially, would political parties in Taiwan have been able to form disciplined institutional cores if the KMT had never come and shoved their ideology down Taiwan’s throat? 


I don’t know. Perhaps not. Assuming, however, that what happened was a ‘blessing’ sounds to me like making excuses for colonization. It’s along the lines of “the British Raj was terrible, but without them India wouldn’t have all that infrastructure, like railroads”. As though Indians would certainly not have been able to figure out railroads on their own. Perhaps geopolitical factors would have made such things harder to accomplish, but whether we’re discussing Taiwanese political parties or Indian railroads, they were by no means impossible without all the horrors that accompanied them. The horrors of the White Terror were not definitively necessary for Taiwan to blossom into the democracy it is today.


Templeman then focuses on the “China factor” — the fact that differing views on China remain the primary divide in Taiwanese politics. There’s nothing incorrect in this assessment, and the historical review was on-point. 

Well, on point with one caveat: the KMT doesn't continue to be one of the major opposition parties because of the "China factor", wherein there are two main poles to Taiwanese political affiliation, one pro-China and pro-Chinese identity and one wary of Beijing and Taiwan as part of some concept of "China". Rather, "the China Factor" exists because the KMT brought it to Taiwan. That, however, is a topic for another post.


However, the rise of the TPP in the current election cycle, ephemeral as their competitiveness may (or may not) be, was completely ignored. I’m not pro-TPP by any means, but this felt like a glaring omission when parties such as the NPP garnered mentions. The TPP doesn’t have a clear China policy, but then, neither did the KMT’s Hou You-yih until fairly recently. 


The China factor certainly matters, as much as we may wish it didn’t. However, it only matters for as long as it matters: if the electorate ever settles on a general consensus vis-a-vis China, that “divide” will suddenly boost the ability of one party to dominate. Although partisan identification shows some interesting changes, looking at fundamental support for pro-China policies vs. against them, my bet on where any such dominance might land is squarely in the pan-green camp. 


It’s not like support for unification is on the rise, and even DPP presidential candidate Lai Ching-te has said he would be open to dialogue with Beijing. The DPP openly states that Taiwan is “independent”, adding in a little “called the Republic of China” coda delivered with everything short of a wink wink, nudge nudge.


On the other side, I consistently see the KMT try to hide its more pro-China tendencies: they don’t dare openly state that they’re pro-unification, nor did they dare to speak against the 2019 Hong Kong protestors resisting the exact same government that they, the KMT, want to be closer to. They talk about the fake 92 Consensus, but can't admit that China never agreed to their interpretation that there are "differing interpretations". 


In fact, the KMT/DPP dichotomy, riven along pro/anti-China lines, has given rise to a large group of voters who simply dislike both parties. There are those disillusioned by the KMT but can’t fathom voting for the DPP, often due to a lifetime of pan-blue media inculcation that the DPP are “riffraff” and “troublemakers” — that is, they still don’t believe that the DPP are “institutionalized”. 


There are also those who are angry at the DPP’s failings, and to be sure it is not a perfect party. However, they’re adamant that Taiwan is certainly not part of China, and the thought of voting for the pro-China KMT, with its lingering scent of the authoritarian era, is an anathema to them. Basically, “the party I would typically vote for sucks, but the alternative is even worse!” 


(If that sounds a lot like some Americans pissed at both the Democrats and Republicans, well, it should.) 


If it’s a “blessing” for the two dominant parties to be the imperfect “they’re corrupt too!” DPP and the “but they murdered my uncle and insist I’m Chinese” KMT, then I’m not as optimistic for Taiwan’s future as Templeman is. I don’t think Taiwan’s democracy is in dire straits -- far from it -- but thinking of it in these terms makes it seem more troubled than I would otherwise believe, not less. 


Templeman continues by noting that the KMT is the “indispensable” foil to the DPP not only because they’ve managed to survive into the democratic era, but because they continue to have huge resources at their command. Is this actually true? As Donovan Smith recently noted, they’re still reporting funds effectively frozen by the transitional justice committee, and might actually be in danger of bankruptcy. I’ve heard multiple rumors over the past few years that they struggle to pay their own people. They have a legacy as one of the wealthiest political parties in the world, and certainly the wealthiest in Taiwan, but that may be more a memory than current fact. 


I’m deeply unconvinced by the next section: 


Commentators and academics in Taiwan, especially those sympathetic to the DPP, frequently bemoan the fact that the KMT survived into the democratic era and continues to play a leading role in politics (e.g. Baum & van der Wees, 2012; Hwang, 2016; Schafferer, 2010). In this view, the KMT’s authoritarian inheritance, including a murky collection of businesses, investment holding companies, buildings and land plots, and other assets that it acquired during the authoritarian era, have given the party an unfair advantage in contested elections; if the electoral playing field were really level, it would have faded into oblivion a long time ago. Thus, the current DPP government is justified in seeking to force the KMT to provide a full account of its finances and disgorge any ‘ill-gotten assets’ back to the state from which it acquired them. Yet the persistence of the KMT as a major electoral force, and in particular as a credible threat to retake power even after it lost control over the central government in 2000, has also had unambiguously positive consequences for the party system, and thus for democratic accountability. And if reformers push too hard to disrupt the current party system in a misguided attempt to resolve these ‘distortions’, they might end up doing more harm than good to Taiwan’s democracy in the long run. 


There’s a very obvious disconnect here: Templeman acknowledges that the KMT had (and has) “assets that it acquired during the authoritarian era, [giving] the party an unfair advantage in contested elections”, but then states that they are a legitimate party because they’re still “a credible threat to retake power”. Yes, they are — in great part because of all of those (erstwhile?) assets giving them an unfair advantage! That’s the whole point. 


It’s like saying “Yes, Brockton Squinglehopper III had some unfair advantages from his family’s massive wealth and privilege, but the fact that he is an adult now and is also massively wealthy and privileged is a sign that he earned it, and that’s positive!” How is it positive, exactly?


As for clientelism, both parties engage in it, but to me at least, it seems the KMT is the far more serious offender. Far from being held accountable, several years on they still don’t understand why preferential pension schemes for their major voting blocs had to be done away with. 


It’s not that the KMT has no true supporters: they do. But they have also had so many unfair advantages, from resources to control of the education system and media to actually being a long-term established party when Taiwan democratized, unlike the DPP. That they continued to win elections is, in part, evidence of how steeply the playing field was pitched — not an argument that it’s inconsequential.


It convinces me of two points only. First, that Taiwan needs credible opposition parties that are stable, disciplined and hold each other accountable. In the past, that has been the DPP and KMT. There is no reason, however, why it would be best for the KMT to continue to dominate over newer parties. The best I can say is that they historically have done so; I don't see a solid argument for why it would be best for that to continue, if the newer party can be just as credible, competitive and respectful of democratic norms. 


Again, a party is only “institutionalized” while it remains competitive, and it’s only an “outsider” until it’s inside. 

Certainly, the KMT cannot be forcibly done away with, and not all third-party opposition is necessarily positive. I see no problem, however, with the KMT dying a slow, natural death as its pro-China views simply fail to garner sufficient support to remain competitive, and its stolen assets are rightfully given back to the nation.


I also have a problem with the idea that both parties are equally committed to Taiwanese democracy. Templeman doesn't say this, but he seems to assume it as a prerequisite for all those "blessings". The KMT kicked out the guy who played the biggest role in democratizing Taiwan (Lee Teng-hui), and plenty of the deepest blue KMTers would happily sell Taiwan to China tomorrow. "You can't eat democracy" and all that. Are they really committed to Taiwan, by any name, as a sovereign nation not united with the PRC? Are they really committed to democracy? I remain unconvinced, because the KMT's own actions have been unconvincing.


I do not think Taiwan’s democracy is rotting away, and I don’t think the KMT should be — or needs to be — actively excised from the political system. But I do not see the authoritarian era as much of a “blessing”. And certainly, I agree that not all change is good, not all outsiders are positive forces, and political parties need credible rivals so that each side may be held accountable to good governance and institutional norms. I agree that the China divide is the primary dividing point in Taiwanese politics. 


However, the KMT’s pro-China orientation, especially the unificationism they try and fail so hard to hide, rapid loss of once-stolen resources, continuing clientelist tendencies and and inability to be accountable for their own authoritarian past all point to one thing: the DPP needs credible opposition, but there is still no reason whatsoever why that has to be the KMT. 


The KMT holds that position right now, but I see no good argument for why they should continue to do so, especially if they die a natural death at the hands of public opinion and a new credible party arises to take their place. 


Templeman's paper is an excellent argument for the historical and political forces that help explain why Taiwanese democracy is the way it is -- everything that's led the country to its present political state, and the benefits of it. It is not a strong argument for the KMT continuing to hold its current status. Even if some of the past they inflicted on Taiwan turned out to have benefits, that’s not an argument for their continued position as one of the two main parties in Taiwan. That position can only be conferred by one force: the electorate. I don’t know which way that current will carry us, but my money’s not on the KMT.

Hou You-yih: Just, like, my opinion, man

I have been so busy lately that keeping up with Taiwanese politics as presidential campaigns kick into gear has been a challenge in itself. Having opinions is tiring; distilling them into coherent points and typing those points out feels insurmountable. It hardly matters: there are so many insights from sharper people than me that you can read, including Donovan Smith, Chieh-ting Yeh and reporting from Nectar Gan, who does the "Taiwan history blurb" better than just about any journalist. If you're still writing "since 1949" in your articles, stop, read Gan's version, and yell at your editor. (Trust me, if they're the "amid rising tensions, China is provoked" type, they deserve it.) 

But I do have opinions, watching the Year in Taiwan Politics unfold as I try to just exist and make all the moving parts of my life cohere into some sort of forward-moving apparatus. Today, I feel like sharing my opinion on the KMT presidential candidate Hou You-yih.

Hou is...interesting. He was chosen by fiat -- for the primary, party chair Eric Chu essentially grabbed the gavel and shouted "Mine! I choose!" But also not: it seems quite clear that Chu doesn't care for Hou personally or politically. I think he'd prefer himself, or some other born-to-be-blue descendant of the China '49ers, certainly not someone who doesn't always toe the party line as envisioned by, say, Ma Ying-jeou. When Chu has all the power, why choose Hou? 

Because, of course, Chu thinks Hou can win. Even when you have all the power, and no matter how deeply embedded your dismissiveness and condescension toward people with ancestral Taiwanese roots, in a democracy you still have to take seriously the person who might be able to win over the public. 

I should be at least mildly relieved: the other big name candidate was Foxconn chair and general asshole-about-town Terry Gou, whose message centers Taiwan's economic development but doesn't even try to hide his slavering desire to sell Taiwan to China for his own "everyone's" profit. Gou tried to position himself as the potential CEO of Taiwan, but all he ever inspired in me was the sort of visceral hatred you have for your worst-ever boss. After all, there are many types of "successful" CEO: the ones who care about both people and business and foster supportive and satisfying work environments, and the ones who focus entirely on money and don't care that their company is a shit place to work.

There's a reason Foxconn has a reputation for a place you park yourself for awhile to make bank, but not a good place to work long-term. Thus, it could be deduced that he might be focused on money, but he wouldn't make Taiwan a better place to live.  For obvious reasons, I absolutely did not want to be any kind of employee in Gou's promised Taiwan, Inc. 

Hou, in comparison, seems like the less-terrifying choice. Apparently, he was once considered a potential DPP recruit. Thus far he's mostly avoided professing the deep-blue pro-China nonsense that disgusts me and turns off most Taiwanese (support for unification with China enjoys no meaningful support, and most Taiwanese don't identify as Chinese). Some of his comments have been pretty sus, though -- for example, that "the Republic of China is a cup, Taiwan is the water", which I won't even dignify with a response. Do enjoy this meme, though:





I could point to other substantive reasons why I don't care for Hou: for example, while I didn't like Mayor Ko, I can't deny that Taipei improved in some measurable ways under his leadership. New Taipei under Hou? Friends who live there complain of sidewalks, where they exist, paved with slippery kitchen tiles, a reduced but still overly-prevalent gang presence and public transit options that have improved but remain frustrating (for example, there are still very few straight-shot transit routes from Luzhou to Taipei; most meander in circles). 

Does it really matter, though? I think we all know that I just don't like the KMT because I think Taiwan is clearly already independent, and the KMT thinks it is some iteration of "China". I am against mass murder; the KMT makes ridiculous excuses for its mass murders in decades past. 

I don't particularly like the DPP's Lai Ching-te, but I simply wouldn't support any candidate the KMT chose, ever. In their current form, any KMT candidate would be too sympathetic to China and not sufficiently willing to defend Taiwan to the last. I'm willing to admit my bias, and I am not even remotely sorry. 

The deepest greens will point to one of Hou's greatest historical mistakes: his involvement in the death of activist, writer and Taiwan independence supporter Nylon Deng. As a police captain, Hou led the raid on Deng's office, which led to Deng's self-immolation.

Hou has said he was "just following orders" and it was his duty to uphold "justice", regardless of the "party in charge". He's said he doesn't have any regrets

I don't think Hou should go to jail. I don't think he should be excommunicated from Taiwanese society. I think, given appropriate contrition, forgiveness is possible: after all, Hou did not directly murder Deng. 

However, I do not think a man such as Hou should be the president of Taiwan, now or ever. 

The Nylon Deng Memorial Foundation has pointed out that before his death, Deng said "they can only take my body, they will never take me alive" -- sending a clear message about what would happen in just this circumstance. One might argue that a suicide threat should not prevent the police from "doing their job", but I do believe Hou had the means to understand that message and thus the likely consequences of his actions at the time. When he says the police mission had "also been about saving a life" but was "not successful", the disingenuousness is palpable. He knew that the mission in fact caused a death, and he had the necessary information to predict it would happen.

I do believe, somewhere deep down, Hou You-yih has the ability to understand what it means to be ethical and principled. In 1989, he had knowledge to understand that what he was doing was wrong. On some level, I suspect he surely knew that he was not upholding "justice" and doing it "regardless of party". I can't prove this, but I think Hou knew that the law Deng allegedly broke, which precipitated the mission, was not just. 

Of course, people act in ways they know are wrong and unjust all the time, and justify it to themselves. "Just following orders". "My boss told me to do it." "That's the rule." I'm the sort of person who will walk away from just about anything if I believe it is wrong, whether that's a toxic person harming others, or a workplace whose actions I cannot defend. Certainly I know people who've said they might do something against their principles if it's necessary to keep their job. Okay -- but they're not running for president. 

A worthy leader needs to know and be able to elucidate right from wrong. They need an inner fortitude that carries them through a clear reflection on their past actions, and the ability to admit they acted unjustly. They need to at least acknowledge the existence of the truth, even if their political career forces them to skirt a direct confrontation. 

When they know something is not right, they need to focus on the steps required to improve the situation. Their solutions may not be perfect, but they need to at least be headed down a vaguely correct path. For example, President Tsai has been fairly weak on labor rights, hasn't delivered quite the necessary changes in immigrant rights and is perhaps somewhat weak on energy policy. But she's oriented in more or less the right direction, and that's good enough for me. It has to be.

And when they see something is truly, deeply wrong, they need to own up to that. This may require walking away. The people I want to lead Taiwan would walk away from their cop job because they were fully aware that the actions they were ordered to carry out were a miscarriage of justice. They'd walk away because regardless of the law, it was wrong -- not for partisan reasons, but ethical ones.

Of course, I'm not stupid. I know Hou would never have done the right thing. Most people wouldn't. It doesn't make them wholly irredeemable. But then, most people aren't trying to be president.

The future president of Taiwan needs a certain strength of character which, from his own statements, Hou does not possess. To point to your "orders" or call something "justice" that you know is unjust is to be weak. 

To be asked about it years later and remain unrepentant makes forgiveness impossible. He could have done better. I cannot imagine ever supporting a KMT candidate, but I wouldn't be so deeply averse to him if he could just face the past honestly and clarify that he understands what justice means -- to admit that he now understands that the law was wrong, and he erred in carrying it out.

Right now, it is not at all clear that he indeed does know what justice means, or perhaps he doesn't care. And a leader who doesn't understand or care about justice is exactly the sort of spineless jellyfish leader who would surrender Taiwan to China without a fight because he was ordered to do so by a sufficiently threatening entity. I don't think Hou would abjectly or directly hand Taiwan to China in the way Terry Gou so clearly wants to, or Ma Ying-jeou tried to, up to and including his solo acoustic 2023 China Jackboot Apology Tour (which probably gave the KMT heart palpitations -- they don't like to say the quiet part quite that loud).

Hou isn't Ma or Gou -- but he wouldn't be Taiwan's greatest defender, either. 

I'm not Taiwanese. Nylon Deng's history is not my history -- but not even I can forgive this, simply because I know right from wrong. Hou is weak, and he is wrong. In refusing to reflect honestly on his past actions, he shows a lack of principles, spine and character.

Hou You-yih may not be an entirely terrible person, but he is a weak man with a weak character who is not fit to lead the country.

The ROC constitution is not the argument winner you think it is

In a spin-off of my last post, I wanted to talk some more about the ROC constitution.

In that post, I described Taiwan independence bait & switchers in that post: people who talk about Taiwanese sovereignty as though it doesn't already exist, but make those statements in relation to China, not in relation to any sort of discussion or debate happening in Taiwan. When it's pointed out that Taiwan is indeed independent of that China, they snottily retort that Taiwan claims to be the "Republic of China", and therefore isn't independent from...that?

Nevermind that they began by talking about the PRC, and the ROC and PRC are different governments regardless. Both governments fundamentally acknowledge this: Taiwan now openly states it, and the PRC talks about how "Taiwan will be ours", which is an admission that Taiwan is not currently theirs.

I mentioned then that a lot of these people will point to the Republic of China constitution, insisting that its wording proves that Taiwan considers itself "part of China", if not the "real China" which claims the territory currently governed by the PRC. 

This is arguably false. I've talked about this before, but have more to discuss, and want to zoom in a little more. As Brendan likes to say, people who want you to swallow China's (or the KMT's) narrative on Taiwan don't want you to learn more about Taiwan. Their arguments work better if you remain ignorant. Those of us who advocate for Taiwan welcome everyone to learn more: the more you learn about Taiwan, the clearer it becomes that it isn't part of China, and doesn't want to be. 

In the spirit of "learning more", I'll be drawing on a useful Twitter thread that deserves a more permanent discussion. 


What are "existing territories"?

In the thread, Drew points out the oft-cited Article 4 which discusses the "borders of the Republic of China": 

The territory of the Republic of China according to its existing national boundaries shall not be altered except by resolution of the National Assembly.

I've discussed this as well -- the article never clarifies exactly what the borders are, and that matters -- but Drew takes it further. He points out that the vagueness was intentional, as the boundaries at the time were indeed somewhat fluid and the language of the constitution had to account for that without any change potentially invalidating the document. That's not just his opinion: he's quoting the Council of Grand Justices:

Article 4 of the Constitution provides: "The territory of the Republic of China according to its existing national boundaries shall not be altered except by resolution of the National Assembly." Instead of enumerating the components of national territory, a general provision was adopted, and a special procedure for any change of national territory was concurrently provided. [Emphasis mine]. It is understandable that this legislative policy was based upon political and historical reasons.


A years-old Taipei Times piece offers a clearer interpretation of this fairly terse ruling: 

First, Article 4 has been ruled “non-justiciable” by the Council of Grand Justices. Asked whether Mongolia was still a part of ROC territory, the council in 1993 issued Interpretation No. 328, which ruled that the legislative intent of the term “inherent/existing” was specifically to avoid setting down precise boundaries, since the areas controlled by the ROC in China at the time were continually shifting with the tides of the Chinese Civil War. The interpretation thus held that the phrase is a political question that cannot be assigned any fixed legal definition. The practical impact of this ruling is that it is legally impossible to “violate” Article 4, since anyone could assert any notion of “inherent/existing national boundaries.”


Essentially, "non-justiciable" means that the Council of Grand Justices has declined to rule on the meaning of Article 4, as the wording is intentionally vague, which is a fundamentally political issue. Thus, it can mean anything to just about anyone. Which, of course, indicates that it means just about nothing at all.

Article 4 is technically no longer in force, but the same wording ("existing national boundaries") is used in the updated additional article, so I'm applying these ideas to both. There's more to discuss here; it will come up again below.

In other words, the judiciary branch of the Republic of China refuses to enforce any legal interpretation of that article, including that it must include territory currently governed by the People's Republic. At this point, the government that currently runs Taiwan has not actively claimed "mainland China" for decades, and continues to decline to comment on any such claim.

And lest you think that this was some sort of partisan judge hack job: in an otherwise jibberish article, even the KMT praises the wisdom of this ruling! I suspect it was meant to be a bit of a smack at the DPP, who had sought to shed new light on what the constitution means to modern Taiwan by getting the judiciary branch to clarify the so-called territorial claims. However, it ended up being a boon to Taiwan advocates: if the wording of "existing national boundaries" is so vague and political that it cannot be meaningfully interpreted by the court, then it can't really be meaningfully be interpreted by anyone. Therefore, it is not meaningful.

Chen Shui-bian is quoted by the Financial Times (and here, the Mainland Affairs Council) pointing out that the question of dubious claims such as Outer Mongolia aren't even the point -- when the Republic of China was founded, Taiwan was a colony of Japan. A 1936 early draft of the constitution did not include Taiwan, which further shows that these "existing borders" are indeed malleable. 

In addition to the Grand Justices, we've now had two presidents of the Republic of China who have insisted that it is an independent country and does not claim the territory of what the world considers to be "China". Three, if you count Lee Teng-hui and his "state to state relations" (and I do). Every elected leader of Taiwan except one has been clear on this. How many government officials clarifying this will it take before people stop making this dead-end argument?

Let's look at the last part of Article 4. I occasionally hear these "Checkmate, Splittists!" commentators say that this needs to be changed by a referendum, but that's not actually true. 


The Additional Articles

The original article states that it can only be amended by the National Assembly, although the amended article, which dates from the early 2000s, gives that power to the Legislative Yuan. The National Assembly no longer exists, and hasn't since 2005, when the replacement article took effect. 

As Bo Tedards pointed out all those years ago, from the Taipei Times link above: 

Second, Article 4 is no longer in effect. It was replaced in 2000 by paragraph 5 of Additional Article 4, which itself was amended in 2005. Although Additional Article 4 contains almost the same phrase, “the territory of the Republic of China, defined by its existing national boundaries,” surely the use of the term “existing” in 2000 or 2005, without qualification, does not mean “existing as of 1947.”


For the sake of comprehensiveness, here's what that paragraph says:

The territory of the Republic of China, defined by its existing national boundaries, shall not be altered unless initiated upon the proposal of one-fourth of the total members of the Legislative Yuan, passed by at least three-fourths of the members present at a meeting attended by at least three-fourths of the total members of the Legislative Yuan, and sanctioned by electors in the free area of the Republic of China at a referendum held upon expiration of a six-month period of public announcement of the proposal, wherein the number of valid votes in favor exceeds one-half of the total number of electors.


The original additional articles to the constitution were promulgated even earlier than that, in 1991. The early-noughts replacement to Article 4 does differentiate between the "territory of the Republic of China" and "the free area of the Republic of China", but I find it hard to believe that many Taiwanese in 2005 -- one year before I moved to Taiwan -- truly believed that their votes from Taiwan could or should have any bearing on, say, Tibet or Mongolia.

Perhaps a few centenarians and some KMT diehards clung to this, but in 2005 most people in Taiwan identified as either purely Taiwanese or both Taiwanese and Chinese. Almost nobody believed themselves to be purely Chinese, a downward trend that began in the mid-1990s. There's no way the general electorate in 2005 still had some inherent notion that unification was desirable. Not even the pro-China Ma Ying-jeou, elected a few years later, dared to say otherwise at the time.

It's difficult, then, to disagree with Tedards. If the sentence "existing national boundaries" was written in 2005, and the Council of Grand Justices has already said it's a vague, political phrase that takes into account the possibility of changing boundaries, then the boundaries referenced in the 2005 replacement of Article 4 can only sensibly mean the Republic of China as it existed in 2005.


Why do the additional articles exist?

When the original additional articles went into effect, President Lee described the re-defined relationship with China as "state to state" or "special state-to-state" relations. Even China saw this move as a blatant shift toward "Taiwan independence". Here's a nice long turducken quote from my previous post on the topic (linked above):

This article is extremely biased to the point of affecting the quality of the scholarship, but it offers up a real quote from Lee and a taste of how angry China chose to be:

According to the transcript released by Taipei, Lee said that since 1991, when the ROC Constitution was amended, cross-strait relations had been defined as "state-to-state," or at least "a special state-to-state relationship." Cross-strait relations, he maintained, shall not be internal relations of "one China," in which it is a legal government vs. a rebel regime, or a central government vs. a local one. Lee's controversial statement, not even known beforehand by Su Chi, Chairman of Mainland Affairs Council (MAC), sent shock waves to Washington as well as Beijing. [Note: Su Chi is the same guy who fabricated the "1992 Consensus" well after 1992].  
For Beijing, Lee Teng-hui's "two-state" theory was identical to the claims by Taiwan independence forces, that treated Taiwan and the mainland as two separate states. Lee had completely abandoned the unification guidelines of 1991, not even paying lip service to the one-China principle. The spokesman of the State Council's Taiwan Affairs Office criticized Lee for playing with fire....In Beijing's eyes, Lee had made an open and giant step towards independence. The "state-to-state relation" theory went beyond the limit of "creative ambiguity" around the one-China principle and represented a major shift towards de jure independence. 


As Drew points out, Chen Shui-bian extended the "special state-to-state" theoretical framework, later calling the relationship with China "one country on each side". Although Ma Ying-jeou represented a break from this clear trajectory, Tsai brought it back into fashion, calling Taiwan "independent" (also linked above). In other words, since democratization there has been exactly one president of Taiwan who has conceived of Taiwan's relations with China as anything other than "state to state", and this framework is directly linked to the constitution as it existed after 1991. 


Miscellany: Tibet, Mongolia and the Provincial Council

The ROC constitution tryhards don't give up easily; they'll often point to mentions of Tibet and Mongolia in the document. To that I say: so what? The Mongolian and Tibetan Affairs Commission was dissolved in 2017/2018, and most mentions of those old claims are either tied to rules regarding the National Assembly which no longer exists, or play no meaningful role in the current government.

The Provincial Council was also dissolved -- you need to use the Wayback Machine to access its old website. Because the constitution stipulates that something like the Provincial Council must exist, a government worker technically fills the lead role, but draws no additional salary. It exists in name only. That whole framework is a ghost, a shadow. It says a lot about the entire ROC-oriented framework of the document as a whole, frankly.

Cherry-picking these bits and pieces of the constitution to make the case that Taiwan actively claims "all of China" as the Republic of China actually makes your case weaker, because there's just so little there there.

Taiwan does not claim China, nor does it claim to be "the real China". It hasn't since the 1990s and that position has only been cemented in the 2000s. The constitution itself says this, if you bother to read it carefully. Only one elected president has ever paid it lip service, and he's hilariously unpopular. 

The entire thing is a massive straw man: it's easy to argue against Taiwanese sovereignty even when one can't deny its de facto existence if one can point to a document and say, "hah, see? Even Taiwan agrees it's China!" But the document doesn't say that, at least not any longer, and few in Taiwan still believe it should.

To be honest, I don't think these constitutional truthers want what's best for Taiwan, nor are they interested in understanding or learning more about Taiwan. If they were, they'd know this already, or be open to hearing it.


So why not change the constitution?


Taiwan did change the ROC constitution -- that was what the additional articles were all about! 

But, I see the point here, and I'll bite: why not amend the core document, rather than add to it? Why not abolish the vestiges of the Provincial Council? Why officially "delegate" responsibilities for these defunct assemblies to other government agencies, rather than change the document that states they must exist? The Legislative Yuan has that power, so why not do it?

I believe the Taiwanese electorate does mostly want this, but it's a deeply unfair question. Why indeed? If it can be done, and Taiwanese people would likely support it, it shouldn't be difficult to deduce the reason why it doesn't happen: not Chinese control, but Chinese threats. 

Taiwan isn't controlled by China now, so changing it doesn't change China's power in Taiwan (that it has none). So why do it, when they're threatening to slaughter you?

Taiwan absolutely does not want a war, for exceedingly obvious reasons. We can all agree it would be a terrible outcome; the only entity who seems to want war is China. If Taiwan is already self-governing and doesn't need to specifically amend the constitution to maintain its sovereignty, and China has threatened to subjugate and annex Taiwan if it makes those changes, with millions of Taiwanese dying as a result, why would Taiwan do so?

Taiwan can and should make these necessary changes when China has resolved not to use force, not to invade, and to respect the wishes of its neighboring country. Until then, what purpose vis-à-vis the PRC would it serve, at such a terrible cost?

Insisting on constitutional amendments that don't change Taiwan's current sovereignty therefore doesn't make any sense, unless you're looking for a reason to blame Taiwan for China's actions. I suspect most of the ROC constitution truthers are doing just that.

It's that same old Catch-22: insisting that Taiwan cannot be "independent" until it makes declarations or constitutional amendments that may cause China to attack, but then blaming Taiwan for "provoking China" if it actually makes those declarations or amendments. There's no way to win, which is exactly what the anti-Taiwan, China-simping ROC constitution truthers want. 

Don't listen to them. They don't know what they're talking about.
