Divorce and Family Dynamics in Taiwanese News

This has nothing to do with the post. I just like the photo.
I know this China-style forced-eviction-and-demolition in Shilin is the big news across Taiwan, or at least Taipei, this weekend (for the record, I'm all in favor of kicking out Hau Lung-bin, just as much because he's an idiot generally as because of this), but another article caught my eye.


This is a perfect example of why no-fault divorce should be legal everywhere in the world. I'm not entirely familiar with Taiwan's divorce laws. I know they used to be ridiculously sexist (a man could leave his wife if she refused to move with him for his work, but a wife couldn't leave her husband over his refusal to move for her work, the idea being that a wife should move for her husband's career but not the other way around) and have since been somewhat reformed, but I'm not sure to what extent. Clearly no-fault divorce with only one spouse consenting to divorce is not permissible, or else this woman would have gotten one.

What bothers me is that the court didn't think that the mother-in-law unlocking the couple's bedroom door at all hours of the night to "check on them" was sufficiently emotionally distressing or a violation of privacy. That says a lot about the power of mothers-in-law (especially the husband's mother) in Taiwan, and yes, while a case could be made that a court might have said the same to a man whose wife's mother was doing the same thing, it's hard not to see this ruling as a sexist one. It makes it quite clear that in the court's eyes, a wife needs to just deal with nosy mothers-in-law, and not listening to objections and having a spouse who does nothing to stop his own mother is not enough reason to terminate a marriage.   

I feel that, well, how could any court possibly be the final decision maker regarding what is and is not intolerable stress or privacy violation? What court has the right to tell you that you must or must not stick it out in a bad marriage based on your circumstances? No court - that's a very personal decision and I don't believe it's something a third party can rule on.   

That said, the wife sort of made her own bed: her husband did offer to send his mother back down south to live, and the wife apparently refused, thinking that others would judge her poorly.

I just wonder why they didn't change the bedroom door lock and not give the mother-in-law a key. I also wonder what the mother-in-law hoped to accomplish. If it was the propagation of grandchildren, barging in on them at random times was obviously not the way to go about it!

It's surprisingly common not just for couples to live with one set of parents (usually the husband's) or near them, or to feel pressured into visiting them every single weekend, or to even give in to in-law pressure to procreate - which, from a cultural standpoint, horrifies me, but it's not my culture. Plenty of Taiwanese people I know seem horrified that my sister lives in Taiwan, I have a spare room, and yet she does not live with me and my husband. Of course, to us, it's perfectly natural that a 25-year-old single woman living abroad with her own set of friends and her own life would want the independence of her own place or roommates her age - to them, it's how can you make your sister live alone like that, all by herself like she's in prison, and paying so much for rent?! Ha. Haha. Well.         

It's also fairly common for the in-laws to have a set of keys to your apartment and to visit unannounced whenever they please, and objecting is not allowed or socially condoned. I love my parents and in-laws, but no. Just no.

And all this ruling says is that:

 a.) A woman's unhappiness in her marriage is not her own decision. She can basically be told that her feelings are "wrong". (A man could be told this too, but somehow I suspect that a lack of initiated-by-one-spouse no-fault divorce means the law is in favor of men, and that husbands would be more likely to be granted the divorce;

b.) A woman has no right to the final decision of what is unbearable in a marriage if it can't be proven to be abuse, adultery or something else that could instigate divorce with fault;

c.) Mothers-in-law have the right to make their childrens' spouses miserable (especially wives);

d.) Taiwanese society doesn't seem to expect the husband to stand up against his mother for his wife.

All of these point to a sore spot of continued sexism in Taiwan that could be easily fixed with single-spouse initiated no-fault divorce. No need to prove anything, no need to obtain consent, if you want out, you can get out. I would trust those who exercise that option to do it wisely and with much forethought and attempted reconciliation, but in the end I'd respect their decision based on their experience in that marriage. I don't feel anyone has the right to rule on that for them. Male or female, but women are especially hurt by a lack of such a divorce provision.

But, ah, the power of mothers-in-law...

I'm reminded of an incident a few weeks ago when we were running to catch a train to Ruifang to take my in-laws to Jiufen - the next train wasn't for another hour and, due to an issue with my EasyCard, we were about to miss this one. It was far down on the track from where we entered - local trains don't take up the entire platform - and my mother-in-law couldn't possibly have run that far that quickly due to health issues. I went flying up the platform to the attendant, who tried to usher me on-board, and with fake tears in my eyes (I'm a very good actress, apparently) I bawled that we needed to be on this train because I was taking care of my mother-in-law who was visiting Taiwan, oh please sir, would you please help me make sure we get on this train?! *sniff*.

And you know what? He held the train. He kept it on the platform for at least 1-2 minutes longer than it should have been just so we could all make it onboard and not have to wait for the next one. 

I highly doubt he would have done that for two young people (although two whippersnappers such as Brendan and myself could have just made it at a sprint). But for a (foreign) mother-in-law, hold that train!!

Similarly, while they were here our water heater crapped out. I called a plumber on Saturday morning. He said he'd be there "in an hour or so".
"Oh no, but my mother-in-law is here!"
"Oh. In that case, I'll come immediately!"

My Second Editorial

Philosophical glove fits all

Albert Shihyi Chiu (邱師儀) gave an impassioned opinion on the spiritual and philosophical immaturity of the Taiwanese, citing qigong masters, temple rituals, doomsday prophets and other eclectic hustlers of heaven, hell and every ghost in between (“Breaking through Taiwan’s babble,” May 19, page 8).

I respectfully disagree with his opinion, not because it implicitly supports secularism — as an agnostic, I am also inclined toward secular philosophy — but because my impression from talking to Taiwanese has been that they are practical about their beliefs. While a few people still surround themselves with superstition, the vast majority are able to separate the possible from the ridiculous. Every opinion I have heard of Wang Chao-hung (王超弘), who “predicted” the nonexistent May 11 earthquake, has been wryly dismissive or humorous (“Are you sure I have to practice my presentation? Don’t you know the world is going to end tomorrow?”)

Furthermore, dealing in the ephemera of folk belief and spirituality is hardly unique to Taiwan. Why single out Taiwanese as philosophically immature when around the world, people are doing the same things with different names and aesthetic trappings? Why criticize Taiwanese when a good portion of the US believed that the world was going to end on Saturday, or when Westerners make, sell and buy “spell rings” and “magic crystals” on the Internet, pay for tarot readings and ascribe supernatural causes to everyday occurrences?

Taiwanese are also hardly alone in other spiritual beliefs: spirit mediums, firewalking and processionals also exist in India, and you’ll see similarities in saint’s day parades in Mexico. You can find an Evil Eye charm in any Mediterranean country for every ba gua mirror and amulet in Taiwan, and if you whittle yoga and taichi down to their spiritual core, you’ll find similarities there, too. For everyone in Taiwan who prays to Confucius or Wenchang (文昌帝君) for a good test score, there’s a kid in some other country begging their own chosen god for some literati luck.

I cannot say that people who believe in these things are intellectually inferior or use religion as an opiate. I believe they have a way of looking at the world that, while I might not agree with it, works for them. To criticize Taiwanese for this is to criticize most of the world. If Taiwanese are not philosophically mature, then nobody is.

In fact, I’d say that Taiwanese spirituality is a part of what I love about this country. I see these beliefs as a window into one culture’s traditions and world view and as artistic expression. Would Mr Chiu prefer that Taiwan become more like China, turning out the “old religion” in favor of ... what? Nothing at all? “Nothing at all” might be my philosophy, but I find learning about the myriad beliefs and traditions in Taiwan to be deeply enriching. Whether or not you burn ghost money or throw fortune blocks, these things do provide the open-minded with a chance to see life and philosophy from a fascinating perspective.

But anyway - tucked in a lane off Xinsheng S. Road near Tai-da, this store sells everything to meet your pro-Taiwan, anti-China needs. Want a Taiwan passport cover to cover up your ROC passport (or any passport)? They've got that (above). Want the complete songs of the imprisoned A-bian on CD? They've got that too (below).

They've also got those old-school postcards that I love so much, decorated with old prints of Taiwanese cartoons, vintage product labels and ads, antique maps and posters.

There are also aboriginal-style glass bead knickknacks, posters, a selection of Taiwanese movies (including Monga) on DVD and plush green pillows shaped like Taiwan that feature cartoon depictions of well-known DPP politicians.

The Butterfly Effect

The following is a somewhat sappy tale, but it's entirely true and, I figured, worth mentioning.

About a month ago, my student's grandfather died. He was 92 and had lived a good life, so while his family grieved, they were also heartened that he lived to such an old age and was in good health for most of it.

He lived in a more traditional time when men ran the household and brought in money, women married young and kept house while popping out babies and children were firmly controlled by their parents up to and often after their own marriages. Daughters were not always wanted, and were often given away to infertile families as open, semi-official adoptions. Some were sent to live with other families with the understanding that they would be raised as daughters (or maids, depending) until they could marry the son of the house. That's exactly what the old grandfather did with his three daughters; he sent them away to live with other families so as to concentrate on raising his sons. The daughters knew where they came from, though, and often came home to visit.

They visited again when the old grandfather died - one a professional swimmer married to another athlete, the other successful in the banking industry and the third a homemaker in name, but everyone knew she was the brains behind the family business. The old grandfather's own family business happens to be fishing; my student was sent to study and work in business while his brother, it was decided, would continue in their traditional industry. They were not typical fishermen, however - they were in the toro tuna business. Toro is one of the highest quality tuna fish in the world; it's used for sushi and sashimi and is widely considered a luxury good. What I mean is, while laying in his casket, the grandfather may have looked weathered and saltwatered from years of fishing, but that casket and the flowers and other funereal gifts surrounding it were quite lavish.

In China and Taiwan, people often believe in something called tou qi - or the seventh day. On the seventh day, it's said, the soul of the departed returns to earth. That soul, apparently, is embodied in a butterfly - hence the famous opera "Liang Zhu" or The Butterfly Lovers.

On the seventh day, just before the funeral, the entire family including the three adopted daughters was in the family's ancestral home in Yilan in an area that does not have many butterflies, even though Taiwan is well-known for being packed with butterflies in general. According to my student, a butterfly flew in through the window and alighted on the grandfather's body - setting aside my own queasiness from the idea of keeping a departed loved one in the house for seven days - that was apparently something big. The butterfly then took off, touching the heads of everyone in the room and the grandmother, now a widow, twice before leaving again.

Astounded, the family had the eldest son throw fortune blocks to ask - Was that you as a butterfly? Yes. Did you come back to say goodbye? Yes. Are you happy now? Is everything OK? Yes. Yes. The family's sadness lifted, if just a little bit.

My own student told me he hoped he'd get to be that old, and vowed to spend more time with his aunts.

Just the other day, at another company, when I asked my student how his weekend was, he looked grief-stricken. Apparently a well-known sales rep at that company, his close colleague, had succumbed to pancreatic cancer and her funeral was held over the weekend. There were both Buddhist and Catholic ceremonies, as she was Buddhist but her husband is Catholic. During the rites, her two daughters began crying "Mama! Mama!", not realizing she was gone. That made everyone begin crying; the woman had been in her mid-30s and had only just begun to build the life that the old grandfather had. Many of the attendees were her colleagues, so the death threw a shroud over daily office life.

I saw the same coworker a few days later after another weekend had gone by; he's the sort who works hard and gets ahead, often skipping activities with his family, even on the weekend when he's off attending conferences and symposia.

"When I was home yesterday," he said on that Monday morning, "a butterfly flew in my house."
"Oh really?"
"I thought about it and remembered those two sad girls cried at N-----'s....her...."
"Funeral."
"Yes, funeral. I thought even though the Buddhist person who called her ghost said she was OK, I think maybe she misses her daughters. So I said to myself I shouldn't do that. I shouldn't work so hard and spend less time with my wife and kids. When I am die, if I am die early, I want my family to remember spend a lot of time with me. Now I will work hard, but not work SO hard, and try to have more weekend days with family. Tonight I want to finish my work by 7 so I can go home and eat dinner with them."

I know. Sounds completely fabricated, like something out of a contrived short story. It's not - these are two stories told to me by two different students.
