Forget the butt-wiping, let's talk about sexism on EVA (and other airlines in Asia)

Gotta say, dudes, I don't want to write about this. I just don't.

I tried to avoid it - like, okay, this was pretty gross and could be a post about sexism in the Taiwanese workplace, especially as it relates to flight attendants (one of the most sexist work environments in Asia, to be frank, and EVA Air is known for specifically hiring beautiful flight attendants). But...do I have to? Maybe it'll just go away as some sensationalist garbage and I can write about something that doesn't make me want to gag.

But, as the story progressed, I realized that, gross-out factor and tabloid-like sensationalism aside, it was a real story of sexist workplace culture, and therefore...ugh. FINE.

So, as I'm sure you all know because we're all news bottom-feeders at heart (myself included), earlier this week news broke that an EVA Air passenger with mobility issues requested that a flight attendant help him lower his underwear, keep the door open and wipe him after using the restroom onboard. She initially refused, but he insisted he could not do these things on his own. He also, according to Focus Taiwan, made some disturbing comments at the flight attendant, which I won't publish here but you can read about literally everywhere else. While the passenger did have mobility issues, frankly, if he is going to fly but can't use the bathroom on his own, he needs to be traveling with an assistant who performs these duties in an official capacity, or not at all.

That's not what I'm here to gawk at, specifically. This should be open-and-shut: passenger harasses flight attendant (this surely counts as some form of sexual harassment, given his comments), flight attendant complains, airline intervenes, supports their employee, and at a minimum, the passenger is banned for life.

But no, of course that's not the end of the story, because the world is a horrible place and really it ought to just burn.

According to the Focus Taiwan article linked above:


Moreover, it was revealed that the passenger in question defecated in his underwear on a previous flight in May 2018, after which the airline did not place him on a blacklist, but rather left frontline flight attendants to deal with the man every time he flew with the airline, the union said.


CNN reported that EVA Air is insisting his previous flights were without incident, but that:


At the Monday press conference, the flight attendant was accompanied by a representative of the local flight attendants' union and fellow EVA employee. The union representative told reporters the man had flown EVA from the US to Asia numerous times. He had defecated in his seat during a flight last May after the crew rejected his demands, causing a foul smell in the entire cabin for over 10 hours, the representative said.


Taiwan News provides some potential background to previous incidents, so although they're not a source I care to link to, I will here.

So, this isn't an issue of a one-off incident in which a passenger made an unreasonable request, and the flight attendant was too flustered to forcefully refuse him (after all, her job is in customer service). It's entirely likely that this passenger has a history of such behavior, and that EVA Air, in the past, has not protected its flight attendants from it.

Like I said, working as a flight attendant one of the most sexist work environments in Asia. While I have said that of all the countries in Asia, Taiwan has the best gender egalitarianism (and meant it, and will defend it), that doesn't mean it's perfect, or even particularly good. Just better than other countries in the region, and that's not a particularly high bar to clear. And in this particular sector, the company culture is a throwback to the 1950s.

What's more, the same article reports that he has another flight with EVA booked this May, with no sign from the airline that they are intending to blacklist him or refuse to let him fly. It's quite likely that the company will, yet again, "leave frontline flight attendants to deal with the man".

EVA also noted that:


Later Monday, EVA issued a press statement saying flight staff are perfectly entitled to refuse passenger's requests they consider inappropriate. They also pointed out that the male cruise captain also helped the passenger in question during the flight.

The company also said it backs the flight staff completely and are prepared to offer assistance, if needed, to sue the passenger.



Translation:

"You've spent your entire career being told you have to do whatever it takes to please customers, and you know on some level you were hired mostly for your looks anyway. Our official rules state that you may refuse passenger requests, but let's be real. If the passenger complains, you'll be in trouble for not providing good service. However, we will be sure to tell the media that you could have refused the request, even though we both know you couldn't, really."

I don't expect every reader to understand this, but many of us who's held a customer service job have dealt with this tacit set of rules. There's the rule the company touts as official policy (you may refuse the customer), and the rule you know you are actually expected to follow (you'll be in trouble if the customer complains). If you're a woman, there's a whole new layer to it in which official policy may state that sexual harassment is not allowed, but everyone knows the real rules are "if a customer gets angry because you shut down their harassing behavior and complains, it's going to be a problem for you."

Note, for instance, that EVA is essentially saying here "we back our staff....buuuuuuut we're still going to let this man fly again and they'll have to deal with him". And, of course, "we'll help you sue him if you want, buuuuuuut we're not going to take any action ourselves."

That, readers, is how you know there's a tacit set of rules in place. If the rules actually were the rules, this guy would've been blacklisted already.

And that's what makes Asia such a frankly difficult place to work. Laws typically prohibit gender discrimination and sexual harassment. If you file such a complaint (especially a gender discrimination complaint to the government), they will take it seriously. I would know - I looked into doing so once, to a former employer who had sexist work practices, but ultimately chose not to as had no documentary evidence aside from one contract with some vaguely sexist guidelines, only eyewitness testimony.

But...good luck getting your employer to back you. And you know that men who target women at work tend to be quite good at making sure not to leave a paper trail or even witnesses. It's one of those rights that women in Taiwan often call "看得膽吃不到" - you can see it, but you can't eat it. You know you have the right, but good luck actually exercising it.

And this is gearing up to be just such a situation, with EVA continuing to take a weak position on the customer's behavior and not doing much to actually protect its employees. Or as CNN put it:


Supporters of the cabin crew have also blamed the corporate culture of many Asian service-sector companies that insist the "customer is always right" while, according to critics, ignoring employees' welfare -- especially after it was revealed the passenger appeared to be a repeat offender.


This post wouldn't be complete without a tirade about why, if this is service culture in Asia, it's no wonder there are so many creepo Western guys here looking to get off on their fetishes with Asian women (who, as in this case, may not be consenting). When employers in all manner of hospitality industries take this attitude (or, in some cases, cater specifically to it, but at least at hostess bars/KTV you know what you're getting into), men who think they can treat women like garbage come here and, well, get away with treating women like garbage. It's no coincidence that this man had repeated incidents on Asian airlines. He knew he could get away with this, and it looks like that just might happen.

There is something we can do. We can write to EVA and let them know that as potential customers, we expect them to treat their flight crew better. This is one time when voting with our wallets might have an effect: not buying EVA tickets in solidarity with the flight attendants would surely get the airline to reconsider its weak-kneed response. When we see behavior like this in public, we can stand up and say something, even if it might be awkward or uncomfortable.

And I don't just mean Westerners. I know I have plenty of Taiwanese readers. We - all of us - can do this. Because the treatment of women in these positions has got to stop.

Taiwan needs to figure out how to treat foreigners better

It pains me to say it, but Taiwan has some deep discrepancies between the human rights ideals it claims to espouse, and how it treats not only its own citizens, but also those who come to Taiwan to study or work.

Instances of Taiwanese universities using the New Southbound Policy as basically a vector for scamming Southeast Asian students are starting to feel not like horrifying exceptions, but the norm. It's happened now with not just Sri Lankan students (news of which broke just months ago) but Indonesian ones as well, at more than a handful of universities.

These universities take government subsidies meant to help them attract students from Southeast Asia, and then use them to pay brokers to bring students over. These students are then assigned jobs in factories, and attend class only a few days a week, if at all. These factory jobs are called "internships", but they aren't learning opportunities - they are basic blue-collar work - and they aren't even allowed for first-year students, and certainly shouldn't be taking up most of one's week, as work is limited to 20 hours/week for foreign students here.

These are scams aimed at getting free labor - or even labor that has paid to be there, as some of these students are paying tuition to do this. They are violations of human rights.

Taiwanese people would not accept this happening to their own citizens, so it disgusts me that it seems to happen so easily to foreigners.

The "university" system here isn't the only vector for abuse - how domestic workers (who are predominantly female) and fishing boat workers (predominantly male) are treated, not to mention regular factory workers, is obscene. 

Taiwan is trying to take a big step forward by reducing its economic dependence on China through re-invigorating ties with Southeast Asia through the New Southbound Policy. But the high-minded ideas of the central government just aren't trickling down to those meant to actually implement it through outreach (including businesses, employers and universities).

Attempting to take advantage of a government policy aimed at improving the country to line one's own pockets is not unique to foreign residents or the New Southbound Policy (certainly this happens in the domestic sphere as well - just ask how property developers circumvent the "green space" law by giving politicians reduced-price apartments they can flip and profit from, or how some local politicians take advantage of local charities). However, I can't help but think in this case, there's an element of racism at play.

If this were happening to Taiwanese, the outcry would be swift and condemning. Instead, the government "will conduct an investigation" (hardly decisive action they need to be taking). This after it's obvious that those in government who set up the programs with universities - if they can even be called that - knew how likely it was that they would try to take advantage of both the government and the foreign students. If they weren't aware of this possibility, they wouldn't have talked to the university presidents in person and warned them off doing exactly this. 


Initiatives like the New Southbound Policy aren't going to work if the people in charge of actually implementing various initiatives are using them merely to take advantage of Southeast Asian people. They're not stupid, guys. They know that there's a lot of racism against Southeast Asians here. They know that these scams exist. They know that they can't necessarily trust these programs. And neither the people nor the governments there are going to stand for it. They are already angry.

I'll say it again: if Taiwan continues to be known for treating Southeast Asians badly, and is seen as using the New Southbound Policy for their own enrichment with little concern for the effect on Southeast Asian people or economies, it's not going to work. The New Southbound Policy will fail, and we'll be stuck with a choice between China strangling our democracy or our economy - exactly the thing we seek to avoid. 


One of the things that has really impressed me about Taiwan is how this country consistently pushes itself to live up to its purported ideals: democracy, freedom, human rights. It's not that other countries don't do that, but Taiwan seems (to me anyway) to make more progress more quickly than other parts of Asia, and the struggle just seems more visible here (and more accessible in terms of being connected or understanding, on a personal level, the bleeding edge of the push for social change.)

But we have to admit that Taiwan, as much as it may be a place one can love deeply and make a commitment to, is far from perfect. That's true not just in terms of how it treats its own citizens, but how it treats foreigners here. It has ideals, but as things stand right now, it simply doesn't live up to them.

IELTS takes a political position (and my ongoing battle to fight The Man)

As my husband noted in his nail-on-the-head post on the same topic, pretty much every IELTS teacher and examiner we know is horrified by the change on IELTS's website of "Taiwan" to "Taiwan, China" (Notably, Hong Kong and Macau bear no such designation. If I didn't already know this was all about politics, I'd say that's odd).

Many of us have written to IELTS to protest the change, including me. I'd include a screenshot, except that e-mail contains references to the nature of my employment which I cannot divulge, but which when blacked out render the letter incoherent. Suffice it to say, it was an angry but basically formal letter of protest and complaint.

We all got the same completely irrelevant form letters in reply, which didn't actually address the issue we wrote about:

"Thank you for your enquiry and comments. The IELTS Partnership is updating IELTS websites and materials in order to ensure that IELTS remains available to test takers in Taiwan. This is where I got a little testy. I'd say "I have a short temper", but several days on I decided to send this anyway. It won't make a difference, so please enjoy it as a retort created for your entertainment:

"If you consider them 'Taiwanese students', why do you list their country as being 'China'?"


Here's the thing. I know perfectly well that we're probably not going to win this, because The Man doesn't care about our tinny complaints. It pretends to be apolitical while taking a political, pro-Beijing position. And that is what you're doing when you list Taiwan as "Taiwan, China": you are taking a political position. You are saying Taiwan is a part of China, a position most Taiwanese do not agree with.

It's hard to fight the power, which as a friend pointed out, is the entire point of having power - so it's harder for people to fight you. IELTS pretends to be a dispassionate language proficiency test, but it's also a source of power: are you a non-native speaker who wants to study in the UK (or other countries) or get certain kinds of visas? You have to take it. It's tied to the government through British Council and the UKVI service. That's power. It's not just a test.

It wants to think it's not The Man, but it absolutely is. And as The Man almost always is, IELTS is wrong.

For me, this is the point at which "Taiwan, China" stops being an abstraction: it's not just an unfair, stupid thing that terrible companies do for money. It affects me personally: I'm associated with the brand. Some of my income comes from them. If I refuse to accept this, there is a real impact on my life, moreso than boycotting airlines or slagging off TOEFL. I don't earn money from those companies. I don't know how I can take dirty money now, so for the first time in a very long time, I'm faced with a choice between a chunk of my income, and my principles.

As China expands its forcefulness, more people like me will start facing that choice. I have to hope enough of them will choose principles, as I'm headed towards doing, but I know that many won't.

This isn't a small issue relegated to Taiwan and China. It affects people like me. It affects international workers and foreign residents.

And, as Brendan pointed out in his excellent post (which you should absolutely read), IELTS is essentially helping China accomplish its political goals, which serve as precursors to its military goals:



The government of the PRC would like nothing more than to take over Taiwan and incorporate it into their territory....This is not the ranting of a conspiracy monger -- China isn’t even trying to hide its intentions. 

 Whether China takes Taiwan by force or by “peaceful” coercion, it doesn’t want the rest of the world to see it as a larger country taking over a smaller, less powerful country. That would look very bad. Instead, China wants the rest of the world to see Taiwan as a recalcitrant part of China that needs to be brought to heel. That’s why (among many things) it’s got people pushing to change “Taiwan” on those drop-down menus to things like “Taiwan, China” or “Taiwan, Province of China”. It’s all about changing the world’s perception of Taiwan so that if Invasion Day comes, the rest of the world doesn’t see Xi Jinping as another Hitler invading Poland. 

And every airline that lists Taiwan as China and every educational institution that forces students to declare their country as “Taiwan, China” is complicit in this. With Beijing -- not politically neutral.


I don't know how to fight that. I don't know how to tell you to fight that. I'm still weighing my options, although I know that not acting is not an option. I don't know what to tell my students, except not to take IELTS.

I know some Taiwan-based examiners read this blog. I know a lot of Taiwanese do, too. I don't know what to tell you.

I considered suggesting a strike, and still think that might be a possibility. I worry, however, that it will hurt local centers like IDP Taipei, who are not our enemies (I suspect a lot of the local employees of IELTS centers are on our side, in fact) without really hurting IELTS as a global organization. It might be our best shot, however, at getting this story to stay in the news and embarrass IELTS as much as possible.

I considered a petition, but TOEFL ignored the one directed at them, and IELTS will too. That's what The Man does - he ignores petitions, because he has power.

I considered saying you should change your scripts and say explicitly that Taiwan is NOT CHINA, but that could hurt candidates' performance and that's not fair. It's not their fault (even with the Chinese candidates, it's not their fault at all that their government sucks).

Of course I will continue to encourage Taiwanese students not to take the test.

Something more should be done, but the result has to hurt IELTS Global. What should that something be? I don't know yet. But I have no intention of going away and I have no intention of quietly choosing money over principles.

All I can say is that I encourage you to organize (and feel free to get in touch with me, by the way. I'm easy to find). Be creative, and don't back down. The Man usually wins, but that doesn't mean you have to sit down and obey meekly.

I wish I had better advice, though. I'm not sure what the next move will be, but I can assure you we're not done here.

Taiwan has made me more skeptical of free market solutions

It is really hard to love Taiwan sometimes.

From The News Lens, which really hits it out of the park when they want to, Taiwan's bus drivers face atrocious conditions, and it impacts public safety:


If the driver is at fault for a major accident they will have a strike against their name, and if they accumulate three major strikes then they will be dismissed; the drivers who have accumulated two major strikes will usually spend their days off making up for their “accidents.” This is seen as a "voluntary service" so their names will not show up on the work schedule, but of course they only have time for this when they are not working.


The result is that even though they have a day off, they end up working every day of the week, and the day after volunteering, they have to drive the bus, but as they are still tired, they will probably cause another accident, receive another strike against their name and will therefore have to volunteer again… completing the vicious cycle.

and

If the driver causes an accident, the Public Transportation Office (PTO) will check their work hours within the last three days, but the company will have the legal team tamper with the shift records, so that it says the driver only ever worked a maximum of 10 hours a day, even if they have worked more....

This meant that each person in the law team shouldered the responsibility of forging documents, something we could not hide as the documents have our seals stamped on them. If the company was charged with fraud, then whichever team member was on duty that particular day would have to bear all legal responsibilities, and would be seen as an accomplice....

If the records were not changed, the company forced that team member to bear the financial burden of the fine, either upfront or from their salary. I have also witnessed the company force the rest of the legal team to pay for a fine, after the original team member had resigned. It was the most ridiculous situation ever and really emphasized how unjust the company was.

...and so much more, but go read the article. 

All of this could be avoided, and service remain the same, if they just hired more people.

But they won't, because there is no mechanism in the market that incentivizes them to not be two rungs above slavers (I'm being generous - they get two rungs!) and politically, everyone knows about these endemic problems, everyone knows companies skirt the law, and yet enforcement remains lax. It can't be anything other than intentional.


This is also why I'm skeptical of total free market solutions to problems: free market solutions generally hinge on consumers having the power to create change, but I see no way to do that here. Many people must ride the bus - some for economic or location reasons, others because they have reasons why they can't drive (I'm not willing to drive in cities, for instance, and it would be compromising another value of mine to buy a vehicle.) They can't refuse to board until conditions get better for drivers or the buses are safer to ride. They might prefer happy, rested, fairly compensated drivers, but they will have to get on that bus whether it happens or not, so companies have no market-based incentive to change their exploitative behavior.

Neither is there a solution in which people just don't take those jobs, forcing companies to offer better conditions to get new hires in the door: they just plod on, understaffed.

I simply do not see a solution here that does not involve some enforcement of government regulations. 

Yet, not solving these sorts of issues is not acceptable.

The government has sure fallen down on this one too, but unlike corporate overlords (whom we have no power to wrest from their cushy jobs), we do have some power to insist on elected officials who take labor violations seriously and are willing to fight the rot they know is in the system. Even the proposed solution in the article: to note the driver, time, place, license plate and route number - involves engaging the government, not using the miniscule droplet of power the market affords you.

I don't hold out much hope that a political or governmental solution would do much good either - not yet, anyway. Taiwan just hasn't developed a labor movement the way some other democratic have, most likely because they left Martial Law (and the rampant exploitation that could not be escaped under that system) not long ago. There hasn't been a lot of time to evolve.

While there may be some slight cultural factors, generally I believe people are people. They all know what overwork means. They all know what it is to be exploited. There's no "Confucian" ideals here keeping rotten work conditions and low pay in place. It's not passivity either: have you been to the major protests, the ones that have changed the country? Taiwan may pose as a passive country on its face, but when it gets down to tacks, it's not.

Y'all pirates. And that's great. I just want to see Taiwan take that "let's protest this shit 'till their on their knees" attitude they have toward political problems and apply it to businesses and labor issues too. And really do it. Like, occupations and hundreds of thousands, strikes across the country. 


You've burned it down before - you forced the KMT to allow democratization. That was you, not benevolent leaders kindly giving you freedom.

Now it's time to burn it down when it comes to labor. Don't wait for bosses and CEOs to do better - they won't. It is only by great force of will that I am not overtly calling them "scum". Bring them to their goddamn knees. Force them.

You've done it before, and you can do it again.

Of peanuts and monkeys

This is perhaps the third time I've written about this in a week, but I just have more to say.

I've been thinking about a few issues I'd like to [try to] tie together: reactions to my post about how long-termers in Taiwan aren't here for the money but are aware they're being undervalued, the general state of English-language media in Taiwan, and English as a second official language in Taiwan.

When I wrote about long-termers and low pay here, most reactions were supportive. The negative ones landed into two groups: those who think NT$66,000/month is fair, or even good, pay for a job that requires several years' experience, high level skills and (unfairly) a Master's from abroad, and those who said the pay wasn't important because the job would be good for someone who would be in Taiwan for a few years and would likely just want to beef up their resume.

So, let me toss some word salad about why both groups are wrong before I move on.

In terms of fair pay, the fact that pay is too low in pretty much every other sector doesn't make $66k for this sort of job acceptable. If you can make just as much money (or more) as a Dancing English Clown at a cram school, a job that requires no qualifications, experience, education, training, professional development, skills, talent, work ethic or consistent sobriety, why would you seek to improve yourself so that you might qualify for a higher-level job, especially one that states right in the ad that you'll be doing consistent overtime in a stressful environment?

And why would you want to take all of that education, experience and skill to make just about enough money to drink at Bar 7 and live in a shared flat or rooftop cesspit with paper walls, if you have any hope of saving meaningfully? Because after you pay your student loans on that foreign Master's degree and save NT$30k each month, that's about what you can afford, if you have no dependents. If you've gotten a postgraduate degree, learned Mandarin and acquired translation skills and experience, you are probably not 24 anymore, and would rather live like an adult.

Others say that this job is aimed at young Taiwanese Americans spending some time here but not planning to stay, or for those looking for a springboard to gain experience. This also misses the point: first, this isn't a newbie job. This could have been an excellent post for an early-mid-career bilingual professional writer, editor or translator, who might well have stayed on for years improving not only their own work, but elevating the English-language output of MoFA as a whole. It could have been a boon to both some lucky long-termer and to MoFA, who would get excellent work in turn.

That is, if it had been positioned that way: as a good but demanding job with a great salary, rather than as a short-term lark for an ABC kid with a Master's who's in Taiwan.

This whole idea of getting some experience in Taiwan and then leaving actually bothers me quite a bit: there are those of us who wish to stay, and as I've written three times now, we try to contribute and give back to Taiwan in gratitude for what Taiwan has given us. Although I won't spend paragraphs bashing them, I have less respect for those who come, take what they can get from Taiwan, and then leave. It strikes me as a little selfish. I have a more profound appreciation for those who want a fair shake from Taiwan, but also want to give back to this country in a sustained way. And yet, one of those grab-and-go types will probably get this job. MoFA will have a revolving door of people who never really develop themselves and get merely passable work, and Taiwan won't benefit.

Which leads to my next point - if the national government is serious about sweeping initiatives like making English a second official language in Taiwan, it's going to have to shake up its whole attitude toward a lot of things. It can't have a MoFA attitude towards English education, asking for everything and offering nothing.

The government needs to think about employing the right people (which it can attract with the right offers), taking seriously the idea that teaching, writing, editing and translating in English are professional careers that people do over a lifetime and seeking out those people, and basically getting quality by paying for quality in terms of remuneration, benefits and work environment. There are those of us who want to stay, who can do good work, but who aren't going to be attracted by what's currently on offer. We're here and we don't want to go anywhere - if the government is serious about bilingualism, internationalism and multiculturalism, it needs to provide more enticing reasons to stay, and stop creating jobs aimed at grab-and-goers.

And it needs to take those people seriously when they point out the flaws in the status quo vis-a-vis English education in Taiwan: from a poorly-regulated cram school industry to, as a friend pointed out, the fact that students who only learn English in public schools generally don't come out having learned any English, to the way the exam system, through extreme negative washback, hinders the whole process. It needs to hire people who can then develop something better, and that's where long-termers looking to contribute to Taiwan come in. We - not just me, I'm nobody, but we - can actually do this alongside and in support roles to talented, passionate and qualified locals, but only if the will is there. We can't take a grab-and-go attitude.

This isn't true only for the government, but for the education system as a whole: from buxibans to universities, if you want talented educators who can actually help Taiwan achieve English as a second language, you need to not only give those who are already working toward this end a better environment in which to succeed, but to offer jobs that entice talented professionals, not a revolving door of Chads and Braydens who aren't implementing even so-so curricula well, and will go back to Idaho in a few years anyway without seriously considering whether they actually contributed to Taiwan.

Oh yeah, and if you are serious about multiculturalism, how about treating the many Southeast Asians who come here for work with a little more kindness and respect? Even just better working conditions and pay, not being all racist towards them, and not raping or enslaving them would be a good start.

This bleeds over into English-language media as well. Why is Taiwan News, which is essentially a gossip rag peddling the same sensationalist articles translated over from Chinese-language gossip rags, now the most recognized English "news" source in Taiwan? How'd we hit the bottom of that barrel?

Because there aren't very many jobs for talented journalists in Taiwan, either. By all accounts, the Taipei Times made a go of it once, but are now so under-resourced that even if there were talk of updating its website and media strategy for the 2010s and beyond, the resources just aren't there to make it happen. It was (is?) the English-language paper that both the expats and the Taiwan advocate Beltway crowd read, and probably never would have been a huge money-maker given its smallish target audience, but it could have sopped up the market that Taiwan News is currently engaging.

Great people have worked at the Taipei Times - and some have even worked at the China Post (believe it or not) - but they all leave. Few people build a career and stick with it, because the jobs on offer just aren't that great. We all know about the one guy who wrote a whole book on it (though you'll need a nacho bowl for all the shoulder-chips it comes with), but I've heard this from many sources. Low pay, long hours, hardly any time off (typical Taiwanese annual leave, which means not much at all), difficult environment. No wonder the best journalists they hire, if they can attract them, cut their teeth and then leave. The state of English-language news reporting suffers for it.

A friend pointed out that this has real-world consequences: she was talking about racism in Taiwanese society specifically towards Black foreigners (which is absolutely a thing), but it also has international consequences. If Taiwan News is the best we can are willing to do, and Taipei Times is offering peanuts and putting out thin content, what news about Taiwan from local sources is reaching the pro-Taiwan influencers abroad? What effect does this have on Taiwan advocacy internationally? What effect does it have on reporting on Taiwan from outside sources? Would that improve - because the state of it is pretty damn bad - if local news put out better, thicker, more compelling stories in English (and Chinese, but this post is about the foreign community)?

Could they perhaps accomplish that if they offered better jobs to committed long-termers looking to make a difference?

The long-termers will stick around - most of us, anyway.  We'll continue to fight for Taiwan in whatever way we can, and carve out niches for ourselves. I do the work I do (I have no single employer, by design) because I can get some satisfaction that way, and make sufficient money. If Taiwan wants us to come out of our little self-carved niches and join the fight for real, there have to be opportunities for us to build real careers in important and useful places, which offer adult remuneration and conditions for real skills.

If Taiwan engages the long-termers who are looking to contribute more meaningfully (and the locals too), the country will be better for it. Media, education, the government.

But if this work continues to toss peanuts our way, we aren't going to pick them up.

And everyone who knows us knows...we didn't come for money

I promised I'd eventually pick up where I left off here, so...

Last month I came across this job posting with MoFA (the Ministry of Foreign Affairs) through the Facebook group of Nihao's It Going (and for those wondering why there is no Lao Ren Cha Facebook group, the answer is that I am old and lazy.)

No link because the ad is no longer online. That probably means someone took the job, or they'd have extended the posting dates. It's too much to hope for that MoFA realized how embarrassing that salary offer was and immediately, contritely took the ad down until they could come up with a better offer.

My mouth was agape at the requirement of a Master's obtained outside Taiwan (the hell?), so let's briefly take a look at that. What the hell is going on that the Taiwanese government is announcing openly that Master's degrees obtained in Taiwan are substandard? (I suspect for some subjects, at some universities, they are - but even so, for the government to be openly acknowledging this is horrifying).

Then, look at the salary: NT$66,000/month. And look at what they want for that.


That's...about US$2200/month - enough to live comfortably in Taiwan if you are single or a dual-income couple, but not enough to raise a family. Enough to get by and save a little for some nice vacations, but not enough to save meaningfully for any long-term goals. In 2006, if Kojen (a large buxiban chain) put you - probably a teacher lacking most of this list of qualifications - on a salaried rather than hourly rate, it was NT$60k - not a lot less than this offer, and 12 years ago at that.

Even sadder is that they seem to have enough applications to justify taking the post down from people willing to accept that pay. 

In short, it's a joke. So between bouts of laughter, I've been thinking a lot about why I stay - why any foreign talent stays, when the pay is just this damn bad. More importantly, I've been thinking about that means in terms of the greater conversation about brain drain and attracting (and retaining) foreign talent in Taiwan. Or, for that matter, local talent.

Why some people stay anyway is an easy question to answer: for me, it's a combination. My social life is very much here now. I love my friends back in the US, but there is no denying we've grown apart somewhat (this is less of a problem with friends in the UK). Not only do I find it hard to explain what my life is actually like in Taiwan to friends who have never visited.

Beyond that, I simply care about the country. Assuming I wouldn't move back to the US (and I wouldn't, unless I felt I had to), and assuming learning a new language isn't a problem (and it probably wouldn't be - I'm good at that), I find it hard to imagine coming to care about another place as much as I do Taiwan. Korea, Japan and Hong Kong are interesting - as are many places farther afield and outside Asia - but am I really going to start passionately fighting for the concept of Korean identity, or Japanese democracy or discussing Argentinian history in the detail I do about Taiwan? Am I going to start collecting and reading books about Jordan? Probably not.

Leaving aside the mostly-hideous architecture and other endemic, intractable problems here, there's something special about the place. A spark that caught my eye. A streak of rebelliousness that chimes a matching tone to something within me. A real fight, for freedom against oppression, for democracy against dictatorship, for right (if flawed) against absolutely wrong.

I've also come to learn about myself that even if I cannot vote, I must live in a free society, and one where women's issues have at least reached the level of discourse they have in Taiwan. That cuts out more than half the world, including much of the rest of Asia. China is a no-go, so is Vietnam. Hong Kong isn't quite free. Japan and South Korea have bigger issues with sexism than Taiwan.

And it's convenient - I think there's a law somewhere requiring that I say that. Sure. And I really do prefer living in the developed world, and in a place with a first-rate public transit network.

Oh yeah and all my stuff's here and my cats and all that. Sure.

Point is, if all I cared about was money, there are a lot of places I could go, and make lots more of it. Obviously, other priorities keep me here. 


Other people have other reasons - perhaps their job is more tied to Taiwan, whereas I could find better work if I were willing to leave. Perhaps they've married locally, or are a specialist in local politics or history (things I am personally interested in, but am not a credentialed expert in), or have invested their whole lives in learning Mandarin or Taiwanese.

There are a million reasons why we accept low pay and generally poor working conditions, from the grounded (say, married locally) or conceptual (caring about Taiwan as a cause worth fighting for).

I'm not trying to defend the offering of NT$66,000/month to someone who would earn three times that, or more, elsewhere. I'm not saying that Taiwan is attractive to foreign talent despite being a place where, in many cases, your career can only go so far. In my own life, I'm grateful for the career boost Taiwan has given me, but I also see the end of the road: the point where I could go further in life (and make a lot more money, and eventually earn citizenship) if I were willing to leave. That hasn't changed.

And if Taiwan really wants to attract foreign expertise, they are simply going to have to offer a better, and better-remunerated, work culture. Period. So who cares why we stay?

Mainly, it matters because it breaks down this myth that talent always, in every instance, follows money. It's one thing to say that Taiwan needs to be more attractive to foreign talent. It's quite another to imply the flip-side of that, as some do: that everyone who is talented therefore leaves, or goes elsewhere to begin with, and those who come and stay must therefore not be desirable talent.

Whether we're talking about locals or foreigners, this is simply not fair. If some of us have other reasons why we stay, it follows that at least some of those who remain will have the talent and expertise Taiwan needs, and we deserve better than to be dismissed as losers for sticking around. I know people among my friends and connections here who are: long-termers a deeply committed teacher of children; a generous friend who gives up heaps of personal time to volunteer in underprivileged communities; several formidable scholars and journalists who, in the face of a low-quality media environment, ensure that information about Taiwan is available in a variety of languages; talented teachers of adults who have the training and experience to remake what it means to learn; public figures who bring like-minded expats together; a migrant rights activist; several writers and artists; several LGBT rights activists and more. So many more. Forget me, I'm just a weirdo with opinions - look at the whole picture. 

And yes, there are losers too, and leeches, but we're not all LBHs (Losers Back Home) who can't leave because nowhere else will put up with our bullshit, just because we haven't chased the dollar signs to some other country. We all have our reasons for staying.

Again, so what?

Well, not all of these examples of the creativity, experience and expertise that we bring to Taiwan fit into the little pegs set out by the government. We have a lot to offer, but because we're not necessarily the kind of 'foreign experts' who do chase dollar signs, we don't always meet the qualifications to be considered a 'foreign expert'.

Becoming a 'foreign expert' costs money, especially if you have already built a life in Taiwan, and suddenly find you need to relocate abroad to gain the qualifications you need (hence my problem with the "Master's degree from a university not located in Taiwan" in that ad, although I am obtaining exactly that. Not sure how I'll afford the PhD though, with an entire life that I can't just give up in Taiwan.) Those of us who have other reasons for staying and don't just chase money...tend not to have huge amounts of it.

The way the discussion about immigration and dual nationality rights is going now, it seems most of the Taiwanese government thinks we're all worthless slobs when what they want to attract is "real" expertise, not the slothful degenerates they imagine us to be, showing up to 550/hour classes at Happy Eagle English Scholar's Acadamy still drunk on Taiwan Beer. 

It dismisses those of us who came to Taiwan as nothing and built something, even if we didn't quite build it to the exact specifications set out for 'special' foreign professionals. It completely ignores the ways in which we've looked to give back, and the ways we - the ones who stay despite the crap work culture and crappier pay - are the real soft power.

I know it's a bit odd to say "we're not here for the money" alongside "...but really, we need more money". It's true, though. We stay for other reasons, but things absolutely have to get better, or we may start losing the good people who stayed on regardless.  Those of us who have good but not 'special professional' situations won't move into these more prestigious jobs if the pay is so paltry. 


We deserve better pay and work conditions, just as locals do (and I acknowledge locals need it more). But those who have made something of ourselves here also deserve to be recognized as the people who stayed even when we could have gone elsewhere and earned a lot more, and what that means in terms of the value we add to Taiwan.

Improve English education in Taiwan with this ONE WEIRD TRICK!

My work in Taiwan is dominated by adult students who ask for help with accent training. They need to do business with Koreans, Japanese, various speakers of Southeast Asian languages, Australians, Latinx people, Indians or various Europeans.

You see, all their teachers have been from an "Inner Circle" country (UK, Ireland, US, Australia, Canada, New Zealand). They are therefore most used to those accents, North American ones in particular. They might meet people with those accents, but for business, there is a real need to better understand other Englishes.

My life in Taiwan is unfortunately punctuated by people bloviating about how racism in the English learning industry is somehow acceptable because of "choice" or "the market" or something (their arguments don't make much sense, because they are constructed mostly to avoid confronting uncomfortable issues rather than as stand-alone opinions).

They might try to say that this is acceptable because of some sort of subjective "clarity" of certain accents, although of course how clear an accent is depends in great part on how exposed you are to it compared to other accents (these people are not exactly experts in second language acquisition).

Some pontificate on how it is preferable to be taught by a "native speaker", usually with a very poor understanding of second language acquisition or what being a "native" or "non-native" speaker might actually mean. There is even less recognition that many people in India, Singapore, Nigeria, the Philippines (and more) are, in fact, native speakers, let alone questioning why they aren't recognized as such.

(The answer is racism, by the way. But that's hard for Johnny McBackpacker to admit when it casts doubt on his strongly-held opinion that "the market" is the Fairest Arbiter Of Them All.)

My life in England is characterized by mostly non-native speaking classmates, all of whom are fluent in English, and all of whom know more about the pedagogy of how to teach English than the average Johnny McBackpacker.

Sure, they have accents. But many of them have the accents that my adult students say they need to better understand for their work. Every last one of them is qualified to teach in Taiwan, but many if not most would struggle to get hired here.

We talk about all sorts of things, not least of which is the idea of English as a lingua franca (ELF) or English as an international language (EIL). Most English learners speak regularly with other non-native speakers, some perhaps almost entirely so, especially if they are using English in business or academia.

Back in Taiwan, the consequences are not surprising - all that learning of English from Canadians, Brits and Americans (the so-called 'preferable' native speakers) has actually put those students who tell me they need help with accents at a disadvantage. They get to work and realize, oh, all that time I spent with Teacher Becky listening to dialogues between Tim and Karen, but I actually have to communicate with people who don't speak like Becky, Tim or Karen. I have to do business with Sandeep and Cheng and Fumiko and Nnedi and Abdurrahman and Lupa. 

Of course, most people making hiring decisions are not educators. Even if they realize that they are actually disadvantaging their learners by not providing the English education many instrumentally-motivated Taiwanese learners are likely to need, they don't care. "It's the market." And the market wants white - even Inner Circle "native speaker" teachers who aren't white struggle to get hired.

And I just can't help but think, if y'all hired fluent English-speaking teachers from around the world, ensuring that most learners through their time studying English were exposed to a variety of Englishes, maybe not so many adult learners would come to me asking for help, which I have trouble giving with my Standard American accent. Maybe if we hired more English teachers whose usage represented the speakers and Englishes our learners would actually be communicating with, we wouldn't have this problem.

I mean, I don't want to say "duh", but...duh?

Racism in teacher hiring provokes outrage, but sexism doesn't

I'm sure you're all familiar with Facebook Post Seen 'Round Taiwan, in which a kindergarten teacher at Kangchiao (a famous and extremely expensive international school in Taiwan) seeks substitutes, apologizing as they admit that the school won't consider any "black or dark-skinned" applicants.

Outrage followed. Outrage. Fury. I admit, I also shared the post. With good reason - it's not only blatantly racist, but such discriminatory hiring practices are also illegal in Taiwan.  (Notably, so is working at a kindergarten as a foreigner at all - chances are the teacher isn't aware of this, but the school is and hires foreigners anyway.)

I wonder if any reputable news outlet has asked Kangchiao not just for a comment, not "do you discriminate?" but "what exactly was that teacher told?" and "how many non-white teachers do you currently have?"

But what bugs me just as much as all of that is this:

Over the years, I have taken to task many posters, recruitment agencies and schools for sexist job ads: you know, female teachers wanted, that sort of thing. I've pointed out how many 'better' schools have all male teaching staff. I've been personally attacked for this. I've been threatened ("I'm going to find out who you work for and tell them you're a feminazi", "I'm going to report you to immigration/the tax office because [insert bullshit reason here].") I've been kicked out of and banned from job groups for merely pointing out that an ad is illegal and standing my ground when challenged on that. I've had people try to make the case that sexism in English teaching is okay for whatever (stupid) reasons - usually some tired fugue involving women being more "nurturing" or more professional jobs going to men because there are more "qualified" men, so diversity shouldn't be one facet of the hiring process.

At no point has an ad requesting a certain gender of teacher caused this much anger or made the news in any real way, despite it usually being more blatant than racism in hiring. Of course many if not most schools have racist hiring practices, but they will almost never advertise it openly. But they will advertise sexist hiring practices openly.

That's not to say the blatant racism in this ad shouldn't spark a furor, but that the sexism in other ads should. It's also illegal, it's also discriminatory, there's also no good reason for it, and it's also wrong.

There is no reason why, in a classroom or school situation, that gender should be a factor in hiring a teacher. Some of the most 'nurturing' teachers I know - the best with kids - are actually mostly male. The most dedicated Montessori teacher I have ever met is a man. I can rattle off half a dozen highly-qualified women who could easily teach higher-level classes (Business English, IELTS and the 'prestigious' buxibans) - and those are only the ones I know personally. There are obviously more. There is no reason for the teaching staff at these places to be almost entirely male.

Pretty much the only time I can justify considering gender in teacher hiring is if it is for one-on-one classes which will take place at either the teacher's or student's home. I can understand a female student feeling uncomfortable having a male teacher alone in her home or vice versa.

And yet, nothing - despite the fact that sexism in hiring is not only illegal, but also perpetuates harmful stereotypes (yo if you say I'm 'more nurturing' because I'm female, you'd better get yourself a good strong protective codpiece, buddy. I don't even like kids). It makes it harder for women who want to work with adults - say teaching Business English - to be taken seriously. It makes it harder for nurturing men who want to work with kids to earn parents' trust.

It perpetuates wage inequality as well: those 'nurturing' jobs working with children tend to pay a lot less, too. Surrogate-Mommy-Tracking women into them based on ludicrous notions that they're better suited for those lower-paid roles because they're female, and not bothering about better-paid teaching work being almost entirely done  by men leads to long-term wage gaps.

But nobody seems to be mad about that, and I'm stumped as to why. It's just as much a violation of the law. Every case made for violating the law comes down to "that's what paying customers want", but if what the students (or their parents) want is actually illegal and has nothing to do with who is actually best-suited and qualified to educating them or their children, it doesn't - or shouldn't - matter.

You know, though, about that ad. It doesn't matter either. It won't lead to any real change.

There's a lot swirling around about who said what and why which I won't get into, only to say that I have it on good authority that the problem here is not with the teacher who posted the ad.

The school, as reported in Taiwan News, claims it does not discriminate - but of course they have to say that. They seem to think the teacher "misunderstood" (according to another source) - though (and this is my interpretation here), anyone who has been in Taiwan long enough knows that "you misunderstood" is another way of saying "you embarrassed me/the organization by accurately reporting what I said or otherwise made clear, so now we have to pretend it was a 'misunderstanding' when we both know it wasn't."

And that's just it - nothing will change because if Kangchiao is in fact racist (I don't know for a fact that they are), they'll just try to be quieter or more subtle about it, to ensure that it never gets stated openly again. Even if Kangchiao is not racist, every other school that is (and there are a lot of them) will try to avoid this not by - duh - not being racist - but by trying to ensure that nobody outs them as racist.

The big outrage here as far as the racist buxiban industry is concerned isn't that there is racism in teacher hiring in Taiwan. It's that someone dared to say so openly.

I guess when it comes to sexism they're safe, as nobody seems willing to be outraged about that. And I'll continue to point it out, tell people it's illegal, and be threatened, shouted at and kicked out of groups for simply stating again and again that it's both illegal and wrong.

Mr. Xi's Soft Prong

This sort-of-okay thing that veered into a steaming pile of garbage from the Economist, uh, exists. So that's...there.

Please draw your attention to this paragraph particular line towards the end:

Lin Chong-pin, a Taiwanese scholar and former senior official, calls this Mr Xi’s “soft prong”. 


Ah.

Now we know why Xi Jin-ping is so obsessed with taking Taiwan.

Now, I really hope Lin formulated this thought on purpose, as a big, fat, hard jab at Xi Jin-ping, perhaps hoping we would understand the encoded message in his long, straight, pointed finger.

But even if he didn't, this says a lot. All those powerful cylindrical metal planes circling Taiwan and it's huge rocky mountains, standing tall and erect right there across the strait. He has to take a stab (well, maybe not a stab, more like a flaccid wriggle) at Taiwan to prove to us - and more importantly, to himself - that he's packing heat (well, maybe not heat, more like those squishy hand warmers you can rub. They get warm but they never get stiff). All those big, powerful missiles pointed right at Taiwan, ready to launch.

Because I don't want to linger too long on, uh, Mr. Xi's Soft Prong, let's take a look at the flaming heap of crap that makes up the final two paragraphs of this utter head-scratcher of a piece.

Now I will say, it starts out okay. It could take more time to discuss the perspective of Taiwan, but as it stands it is a pretty clear laying out of China's coercion tactics against Taiwan, which are important for Westerners to know about.

But then....whhaaaaa?



All this is out of the old playbook. Mr Xi’s innovation is to single out young Taiwanese and to pile on the blandishments.

In terms of pay, yes, but if he thinks he's actually going to win them over politically...he's not.


Colleges offer Taiwanese teachers better pay than they could get in Taiwan. Chinese provinces are opening research centres aimed at young Taiwanese. In the southern city of Dongguan, Taiwanese tech entrepreneurs can get free startup-money and subsidised flats.


Yeah, that's the strategy. Want to talk about why it's a problem?


Over 400,000 Taiwanese now work in China. The young in particular are crossing the strait in droves.


I guess not. Well, okay.


You do realize they're not moving to China because they want to, yes? You do realize they are doing it because the economy at home isn't offering them fair wages for fair work, and because they feel it's their best opportunity to make money - but not because they actually want to live in China, yes? Why are you implying that there is anything other than economic rationalization for this? Nobody - literally nobody - thinks China is overall a better country to live in than Taiwan.

Hahahahaha.


In some respects it seems to be reshaping attitudes towards China.


No, it isn't. Identification with China, liking China, thinking China is anything other than a terrifying enemy who must be dealt with for economic reasons, is not actually changing. This is simply factually wrong. 


It does not help Ms Tsai that she has failed to make much progress on her promise to create more opportunities for the young.


Duh, but what does that have to do with China? That's a domestic issue. Her administration is simply not doing a good job with this. 


Taiwan’s economy remains sluggish.


So does the rest of the world's. Want to put what you're saying into perspective a lil' bit maybe?


The young think older generations get the better deal.


This is true but it is not related to China. 


But she gets the blame for tricky cross-strait relations more than Mr Xi does.


Does she? I mean, personally, I think the one thing she is doing right is her cross-strait policy. What's your source on this? 


A recent poll even shows Taiwanese feeling more warmly towards Mr Xi than to Ms Tsai.


Oh, I see, a poll that you don't link to. Hmmm. I'd like to see this poll. How is it worded? What questions are asked? Where is this coming from? Where is your source? Why aren't you comparing Tsai's approval ratings to pro-China Ma Ying-jiu's (man, talk about a soft prong...ahem) to show what it means in a Taiwanese context? 


They do not admire China’s political culture.


No shit. So why don't you say more about this? And if they don't admire China's political culture, why do they admire Xi so much?


But Mr Xi may be nurturing a reluctance among young Taiwanese to bite the hand that feeds them.


They know perfectly well that they are not being fed so much as slowly poisoned. They also know - they're not stupid after all - that slow-acting poison food is better than no food. But if you think for even one second that this is going to change how they feel about China, or Taiwan, or Xi Jin-ping in a way that will get them to accept unification...


...well, then do I have a soft prong for you!

Young Taiwanese are leaving Taiwan in record numbers, and the reason why WILL SHOCK YOU!

Oh wait, no it won't.

The reason why is they want fair pay and reasonable hours. 

"Why is brain drain such a problem in Taiwan?" these articles always ask.

It's because pay is too low and hours are too long.

"OMG China is benefiting from the brain drain!"

Well yeah, because even though the hours there are long and the work culture generally terrible, at least you're being paid better to bend over and take it. If they could earn a competitive wage in Taiwan they'd probably stay.

"How can we resolve the brain drain problem?"

This article could have been written in four words:

FAIR PAY, REASONABLE HOURS

It's not rocket science, jeez. 

"Maybe we could solve it by attracting more foreigners?"

No.

Fair pay, reasonable hours. We are not your excuse or your get-out-of-jail (I hope literal, actual jail because some of these employers need to go to prison) free card to treat workers like garbage. 

This article seems to think China is 'trying' to woo these talented young Taiwanese. 

Maybe, but it hardly matters. It wouldn't work if Taiwan offered labor a fair shake. Most wouldn't choose to work in China if they could get - you guessed it - fair pay and reasonable hours in Taiwan. Bosses who aren't incompetent morons and a work culture that affords autonomy, a voice and a sense of purpose - maybe even the chance to grow and develop in what you do - wouldn't hurt either.

But most people would probably settle for fair pay and reasonable hours. 

This guy who somehow became a professor (wonders never cease) is not only condescending but also wrong.

The cost of living has been rising yet wages have not, which directly affects purchasing power. The difference in pay in Taiwan doesn't reflect the cost of living accurately, at least not anymore. It has nothing to do with choice of career - a total misdirection - and he doesn't seem to go anywhere with his education data.

Basically, he totally misses that Taiwanese are leaving not only because they want fair pay for the hours they work, but also to work reasonable hours.

Nobody - at least nobody that I can find - is reporting on the basic facts:

How do you solve Taiwan's brain drain? 

Fair pay and reasonable hours. It's not rocket science. 

But working overtime helps Taiwanese earn more!

Sure, but that's because they're not earning enough now. Few people who earn enough money wish to work themselves to exhaustion. They're doing it because they need to.

OMG the low birth rate!

Yeah if people earned more they'd have more kids, anyway when they're working all the time there's no time to bone.

Again. Not rocket science. 

But why are they leaving???

LOW PAY AND UNREASONABLE HOURS

So how do we get them to stay??

FAIR PAY AND REASONABLE HOURS. 

Guys. Seriously. Come on. Quit it with your nonsense, spinning webs of words around this very simple problem that literally a monkey could solve.

Most people don't want to leave their home country. Some do - they tend to be the adventurers or those looking for something different. Many return, a few don't. That's OK. Some find the lifestyle abroad suits them better, as I did. But most are happy to stay in the country where they are from if that country is more or less a comfortable/good/safe/friendly place to live. Their friends, family and community are here. They wouldn't leave if they could get good work for fair pay at reasonable hours.

So Jesus Monkey-Juggling Christ, if you want to keep them offer them fair pay and reasonable hours.

I'm not even joking about the monkey. If you devised a test where on one side they had to run on a treadmill for like 12 hours (a typical Taiwanese work day) for ten peanuts, and on the other, they had to run on a treadmill for 8 hours for 20 peanuts, the monkey is smart enough to choose the better option.

Like...seriously. How is this hard?

So are we Garbage Foreigners or not?

Yeah, Taiwanese government. Don't just throw us anywhere. God is watching. 

A few days ago, the Legislative Yuan passed the Act Governing Recruitment and Employment of Foreign Professionals (外國專業人才延攬及雇用法), something the long-term expat community has been talking about for awhile. In theory, the Act gives out lots of benefits to all foreign professionals. In practice, who gets what is less clear.

I'm only writing about it now because it became clear early on that news coverage of its passage was perhaps a more interesting angle to consider than simply providing another analysis of the act itself.

I'll start with the one article I have little criticism of: a News Lens piece on the limbo many foreign artists in Taiwan find themselves in, as the visa laws don't appropriately cover them. This piece correctly notes that the new law makes it easier to apply for a visa independently - as most foreign artists do not have a single employer and may not have an "employer" at all - and also that the new regulations may not include those who arrive for the purposes of unpaid art exchanges.

I'll also get this point out of the way: this Act covers foreign professionals, who are a minority of all foreigners in Taiwan. The majority are migrant workers - mostly laborers from Southeast Asia - will not see any change or any respite in their uphill battle for fairer immigration policy and more protections guaranteeing better treatment while they are here. This is not right.

Regarding all other issues, for those who are interested, you can read an English version of the full Act here (Google Drive), and a Chinese version here (the English version should also be available for download on that site). I do recommend that you do so.

Notably, the Act continues the tendency to differentiate foreign professionals into Foreign Special Professionals (special Lords and Ladies "who possess special expertise needed by the State in science and technology, the economy, education, the arts, sports and other fields "as announced by the relevant central competent authority" which means little except that the government has to designate you as such - this seems to mostly cover old missionaries), Foreign Senior Professionals ("senior professionals needed by the State...as specified in the Immigration Act") and Foreign Professionals (or, essentially, Garbage Foreigners - good enough to get a professional visa to come here, but not good enough to qualify for any other benefits fair-minded immigration policy because they are not really wanted or not really considered 'professionals' despite the visa). Don't think I'm dumping on Garbage Foreigners - despite all of my relevant qualifications, experience and expertise, I am one too.

However, it is not clear to what extent the differentiation will matter in implementation. This is where the coverage of the Act's passage becomes relevant. If you read the Act itself, most of the benefits will be applicable to all classes of foreign professionals - different articles cover each class, but all are covered in most cases.

What this means is that permanent residents like Brendan and I will be eligible for the labor pension scheme, and should I get a university job I'll be eligible for that pension scheme just as a local would. This is brilliant, and something sorely needed. The money isn't much, but it's something, and it's simply the fair and right thing to do.

The Act also stipulates that dependents of permanent residents will be able to apply for permanent residence as well. This is great news for a few friends of mine, notably at least one whose spouse would benefit greatly from being able to apply for permanent residence. This doesn't affect me as I have no dependents and Brendan is now officially a permanent resident as well, but it does affect people I know and care about.

However, the News Lens article on the Act terrified a number of us in the foreign community, noting:

As for “senior” professionals, or those whose spouses, minor children and disabled children may apply for permanent residency along with the worker, not to mention qualify for certain tax benefits, they are likely to be defined as those with a minimum monthly salary of at least NT$160,000 (US$5,300). Again, regulations and letters of interpretation will be issued to defined this as part of the Executive Yuan’s implementation phase.



This language is not in the Act itself, which only refers to "foreign professionals" (as well as Foreign Special Professionals and Foreign Senior Professionals). It caused quite a stir, and even led to accusations of inaccurate or lazy reporting and "spreading false information", but if you read that paragraph carefully, it is clearly speculation regarding how the Act will be implemented. 
The Act's language does differ between Foreign Special Professionals and the rest of us trash, where our dependents have a 5-year residency requirement that is not present in the article pertaining to Foreign Special Professionals. This has led some people to believe that for we regular trashcan dwellers, dependents must wait an additional five years to be covered. However, it's not clear that those five years must take place after the original applicant receives their APRC. It could well be that dependents of Better Superior Super Awesome foreigners can apply even if they don't have 5 years' residency (say, if they joined the working parent/spouse later), whereas we regular roaches don't get this benefit. I'm going to look for clarification on this.

That said, we should all be on guard regarding implementation, as it is possible for extra layers of regulation and further requirements to qualify may be added at that time. 

In fact, I reached out to the News Lens for clarification on where speculation that this requirement would be added came from, and received a timely and useful reply (thanks, News Lens!). The speculative ideas here came from this source.

I suspect, reading through that source, that it's not that those eligible to have their dependents apply for APRCs that will be constrained by the $160,000NT/month income requirement, but merely one definition of what constitutes a "foreign special professional". 

As dependents of foreign professionals (not just Foreign Special Professional Wonderful Lords and Ladies) will be allowed to apply for APRCs, what is defined as a "foreign special professional" doesn't seem to actually apply for this specific purpose. 

So, for now, we can relax. 

It is very important that we stay on our guard to ensure that requirements for dependent APRCs are not regulated to only apply to some foreigners for one simple reason - and I am highlighting this paragraph because it is probably the most important thing I'll say in the entire post: 

It is not fair to discriminate against the children and spouses of some long-term professionals simply because the breadwinner who holds the visa allowing them all to stay is not the "right kind" of foreigner. It is not right to tell the children of comfortable or moderately prosperous foreign teachers that, because their mother or father is not rich enough, or because he or she is a teacher rather than, say, an engineer, that they do not deserve permanent residency in the only country they have ever known or called home. "Sorry kids, I know you were born and raised here and one of your native languages is Mandarin, but your Mom went into the noble profession of education instead of being a highly-paid businessperson, so when you turn 20 you should GTFO and go live in a country you've only visited a few times and feel like a foreigner in!" goes against basic humanity as well as the civic values of what it means to be Taiwanese. 

This is not a threat yet, but it could become one in the implementation phase, and we cannot let that happen.

Another improvement will be the issuance of Gold Cards which wrap a work permit, residence visa, residence permit and re-entry permit (which is odd - your residence permit
is your re-entry permit now so what's the change?) into one, and ensure that you hold your own work permit rather than it being dependent on your employer. 

This would be wonderful, as one major issue foreigners in Taiwan face is that, if they are in a dire or problematic employment situation, it is difficult to change jobs as a malicious employer may attempt to cancel your visa and work permit before you can find another job. Even if you do find another job, some malicious employers cancel your visa/work permit a bit too early before the switch can be processed. I have known more than one person facing this issue, and it has affected how long they'd had to wait for permanent residency. 

Focus Taiwan reports this in a very unclear way, making it sound as though everyone qualifies for Gold Cards (New Bloom makes the same mistake). In fact, only Foreign Special Professional Wonderful Lords and Ladies qualify, not Garbage Foreigners. 

That is to say, most people - we normal plebes - who are likely to find themselves in a bad employment situation will actually not be able to get out of it more easily, because they won't qualify for being treated with basic humanity. 

Another point that has been met which is universally good news is that children born to foreign professionals in Taiwan will no longer have a 6-month gap between birth and when they are eligible for enrollment in National Health Insurance. This is a deeply-important and much needed change, as there have been several cases of new parents, who happened to be foreigners, seeing their financial wellbeing destroyed by spiraling medical costs in the case of medical complications after the birth of their children.

Yet another provision that benefits me is the revocation of the 183 day/year residency requirement to maintain my permanent residence. As readers know, I spent almost half a year in the US in 2015 to attend to family matters after the passing of my mother in late 2014. I filed a petition to leave for a longer period with Immigration before leaving (and such petitions are nearly universally accepted), and squeaked back in under the 183-day limit regardless, but it is conceivable that such a situation will arise again. From personal experience, I know this requirement can be hard to meet. 

Other issues remain unaddressed, however, which few news outlets are reporting. I'm not as concerned about the internship eligibility being cut, though perhaps that's because I'm not a fan of internships generally. I consider them to be at best a problematic institution and at worst exploitative, almost parasitic ("you need us for experience but we're not going to make it possible for you to eat or pay rent"). 

However, I know a few foreigners born and raised in Taiwan who are well over the age of 20, and therefore will not be eligible to apply for permanent residency under this Act. All this group of foreign residents - for whom Taiwan truly is not only home but also their native land and culture - is asking for as we wait for dual nationality laws to be relaxed is to be given permanent residence on the basis of their having lived here, in some cases, all their lives. And yet, because they were born too early, they're still in limbo. 

Another problem is that, for many foreigners, the requirement of "two years' relevant experience or a Master's in any field" to work in any job other than English teaching is onerous. Some may have, say, a year and 8 months' experience (do those extra few months really matter?), some may want to change fields, some may have an extremely relevant Bachelor's, some may have trouble documenting their experience - having worked freelance, or for an employer that will not provide them with the relevant documents, and some may be in industries where experience is not as quantifiable, such as the arts. I know of at least one case where a young man would have preferred to stay in Taiwan after earning a Bachelor's degree, and who had spent much of his childhood in Taiwan, but could not get any non-teaching job (and he didn't want to teach). He went to Japan. I know of another who had nearly, but not quite, 2 years' experience and had been in Taiwan for over 5 years. However, some of that time was spent as a student, which does not count towards permanent residency, and there had been a break regardless (to finish school and care for a sick relative). There is no reason why that should have held her back from finding non-teaching work. 

This is one area where I further disagree with New Bloom (linked above). We agree that immigration controls around the world can be barbarous, acting as unnecessary controls on people rather than in the interests of a country. They note rightly that immigration policies around the world are strict, and Taiwan is no exception.

However, they provide evidence for that claim in all the wrong ways. Unlike countries with stricter immigration policies, Taiwan
wants to attract foreign talent. The strategy, therefore, should not be to mimic other countries who want to tighten controls. 

In fact, New Bloom fails to point out the real difference between Taiwan and many of our countries of origin. It is difficult to immigrate or work in North America, Australia and much of Europe. This much is true. In fact, it's quite easy in contrast to come and work in Taiwan. Even if one is only qualified to teach, they only have to stick around doing that for five years before qualifying for an APRC, which allows them to take any job. That's not bad, considering how many immigrants to the West give up whatever career they had in their native countries permanently, often working lower-skilled jobs in the hope that growing up in the West will benefit their children.

However, once in those Western countries legally,
it is fairly easy to stay. There are paths to naturalization that are viable, and even permanent residents/green card holders enjoy benefits we permanent residents in Taiwan do not. They are also not discriminated against in business the way we are: many obtain mortgages and credit lines, for example, which remains a pipe dream for many long-term residents in Taiwan (although the credit card situation appears to be improving).

It is simply not enough to say "well the requirements in your countries of origin are also strict!" It's more complicated than that. 

In fact, I'd say that compared to the rest of the world it's not only easy to come here for work - as mentioned above - but fairly easy to obtain permanent residence. The bar is high, and a problem for some deserving people, but it is not impassable for most foreign professionals. However, as I've written, in Taiwan permanent residency is not enough to actually stay permanently unless one is married to a Taiwanese citizen (which clears up all or most of the hurdles surrounding credit lines and obtaining a mortgage). 

Related to this but not specifically in reaction to the New Bloom piece, while it is true that around the world countries want to attract certain types of professionals, I am generally against a policy of differentiation of professional work. 

Barring some exceptional cases, most immigrants contribute to the country they settle in, and generally speaking the numbers that come in are more or less in line with the numbers the economy can handle. The reason why is simple: we don't move abroad in a vacuum. We research, read ahead, ask questions and talk to people already in the country we are considering moving to. If all signs point to "it will be hard to find a job and wages and benefits are stagnant because the market is saturated or the jobs simply not that good", that will reduce the number of people coming in as they'll decide to go elsewhere in search of better opportunities. When the market is robust and competitive, more will come, just as it should be. 

This is true for Garbage Foreigners as well as Special Outstanding Wonderful Foreign Lords and Ladies. You aren't going to get the Special Wonderful Foreign Lords and Ladies if your market isn't enticing, no matter how lenient your immigration policy is. And, I've gotta say, I love you Taiwan but the market is not enticing. Frankly, it's not even enticing for foreign teachers. Those of us who stay do so because we care about Taiwan, not because we think remuneration is superb. 

Aww, look at me, sounding like a Running Dog Capitalist! 

If anything, in the case of us Garbage Foreigners, making it easier to move here as a teacher will entice better teachers to come here - people with real qualifications and experience, not just new graduates who have never been in a classroom nor have been trained to teach. This can only improve the country. Some are likely to work in cram schools, raising the level of education at those institutions - working in a university or public school doesn't suit everyone (I could work in a public school, for example, but choose not to).

I have talked to more than one qualified and talented teacher who has either chosen not to come here or not to stay because the labor and immigration laws are not enticing enough to better teachers. 

In any case, a second reason not to discriminate in this way is that most of the benefits in the Act won't apply to the vast majority of incoming foreigners. Most of the benefits accrue to permanent residents (that is, long-termers like me), and the vast majority of foreign professionals who come to Taiwan do not stay that long, or are not intending to stay permanently or semi-permanently, and as such won't qualify. The number of foreign professionals - from Garbage to Special - who will qualify is not only small, it encompasses people who are already here. Nothing will change for Taiwan except that its long-term foreign residents will get a fairer shake. Why is that a bad thing? There is no good reason to tell them they aren't good enough or wanted enough. 

Yes, these provisions will affect new arrivals who, in the future, may decide to put down roots in Taiwan. However, given past numbers (I doubt the total number of permanent residents is above four figures), the impact will not be large. Most Garbage Foreigners - again, the category I fall into - plan to leave within a few years, not to make Taiwan their home. We aren't going to see a massive influx of unwanted filthy stinky buxiban teachers just because permanent residents get a few more much-needed benefits. In any case, 
the contributions these someday-long-termers make will far outstrip the benefits they are offered, and by the time they are eligible they have been already here for some time. 

That the Act felt the need to discuss at length the "limited" need for such Garbage Foreigners is telling and sad. Thanks, Taiwan. Good to know that you had to put into writing exactly how much people like me are not valued.

Finally, as this is an ancillary issue to discussion of the newly-passed Act, New Bloom also gets this wrong:


What leads many to react strongly against and sometimes deem Taiwan a “xenophobic” country is the lack of adequate provisions for obtaining Taiwanese citizenship, in which Taiwanese citizens may be allowed to hold multiple citizenships without being made to give up their original Taiwanese citizenship, but foreigners would have to give up their original citizenship before applying for Taiwanese citizenship, leaving the possibility open that they may become stateless. But, again, although this is a serious fault of the Taiwanese system, this is not exceptional in Asia, in which a high barrier for obtaining citizenship has not been overcome.



In fact, Taiwan's case is exceptional in Asia for a few reasons.

The first is that, again, unlike other Asian countries, Taiwan looks more favorably on diversity. Not everyone has hopped on the internationalization train, but generally speaking Taiwan is not as xenophobic as China, Japan or Korea, especially when it comes to long-term foreign residents. I doubt the majority of Chinese, Japanese or Koreans would support allowing many foreigners to become citizens at all, dual nationality aside. Taiwan is different. A few ethnic chauvinists still exist, but nobody I've talked to - and I've talked to hundreds of people about this issue - is against foreign long-term residents becoming citizens. For many, to be Taiwanese is to participate in a shared civic nationalism, not to be of the same blood as the rest of an ethnic state.

Try playing that card in Japan or Korea (or even China, despite its ethnic diversity - well, China's rhetoric just doesn't make sense in this regard) - good luck. You won't find much support.

Secondly, and I cannot stress this enough, Taiwan is exceptional because unlike other Asian countries, there is a massive double standard regarding who can have dual nationality.

China and Japan, in contrast, do not allow dual nationality even for their born citizens. If a foreigner wants to be Japanese or Chinese (although why someone would want Chinese nationality if they weren't born with it is beyond me), they must give up their original nationality. However, the same is true if a Chinese or Japanese person wants to obtain a second nationality. In fact, in one memorable case, noted author Guo Xiaolu obtained British nationality not realizing this law, and had her Chinese passport cut up by a consular official:



“Do you have a Chinese passport?” She stared at me with a cold, calm intensity, clutching my British passport.
I took out my Chinese passport and handed it to her through the narrow window.
She flipped through its pages. The way she handled it gave me a sudden stomach ache. I sensed something bad was coming.
“You know it’s illegal to possess two passports as a Chinese citizen?” she remarked in her even-toned, slightly jarring voice.

“Illegal?” I repeated. My surprise was totally genuine. It had never occurred to me that having two passports was against Chinese law.
The woman glanced at me from the corner of her eye. I couldn’t help but feel the judgment she had formed of me: a criminal! No, worse than that, I was a Chinese criminal who had muddied her own Chinese citizenship with that of a small, foreign state. And to top it all, I was ignorant of the laws of my own country.
She then flipped through my visa application, which was attached to my British passport, and announced: “Since this is the first time you are using your western passport, we will only issue you a two-week visa for China.”
“What?” I was speechless. I had applied for a six-month family visit visa. Before I could even argue, I saw her take out a large pair of scissors and decisively cut the corner off my Chinese passport. She then threw it back out at me. It landed before me on the counter, disfigured and invalid.

South Korea is a murkier situation. Dual nationality is now allowed for Koreans as well as foreign long-term residents, but who is eligible for it is unclear (I'll have to do more research on this). From the second link:


By submitting the same type of pledge, certain groups of foreign nationals may also acquire Korean citizenship while maintaining their original one. The groups include marriage migrants, foreigners of outstanding talent who are naturalized as Koreans, and those who have their Korean citizenship reinstated by meeting certain qualifications. (Nationality Act, Act No. 8892 (Mar. 14, 2008), last amended by Act No. 10275 (May 4, 2010).


If this means what I suspect - that general naturalization in Korea is similarly restricted to Foreign Special Wonderful Lords and Ladies as it is in Taiwan, and closed to Garbage Foreigners - this still, however, makes Korea and Taiwan the exceptions, not the rule.

In fact, regarding Taiwan, let's call it a triple standard.

If you are born Taiwanese, you can have dual nationality or even multiple nationalities.

If you are the descendants of Overseas Chinese (I'm not sure how specific the requirements are, but certainly if your ancestors were a part of the 1945-1949 Nationalist diaspora), you can have dual nationality, even if your ancestors never set foot in Taiwan. They will give you Taiwanese nationality and let you keep your original nationality. I know more than one person who has successfully done this.

That is to say, the requirements are not merely related to blood. It's pure, clear ethnic chauvinism. It's racism. Your ancestors do not have to be Taiwanese, they merely need the correct ethnic and political pedigree.

If you are a foreigner - just like me! - but your ancestors were Taiwanese, you can be a dual national.

If your grandfather spent a short amount of time residing in Taiwan and you're a really good soccer player, you can be a dual national. Ugh.

But if you have the wrong color skin and the wrong-shaped face, you are a Garbage Foreigner who does not qualify. You must renounce, you stinking piece of crap. Never forget that you are not wanted.

This is true even if you were born and raised here. Someone whose ancestors never came to Taiwan but have the desired political history can be a dual national, but someone who is actually Taiwanese by virtue of growing up here immersed in the culture is not.

This is not true for other Asian countries. Their laws are harsh, but at least they apply fairly to everyone. I don't want such harsh requirements in Taiwan, but I do want fairer immigration policy.

I wish New Bloom had covered the issue in this level of nuance - I generally like their local coverage, especially of student and social movements. Unfortunately, the editorializing here misses the mark and is deeply misleading.

In any case, this is not the main issue - it just happens to be related to the question posed by both the ongoing fight for dual nationality - but both this issue and the passage of the Act Governing Recruitment and Employment of Foreign Professionals lead us back to the same question: 
Are we Garbage Foreigners or not? Does Taiwan want us or not? (Hell, does Taiwan understand basic economics or not?)

The new Act seems to point toward a general opening up of how welcoming Taiwan is to its long-term foreign residents, at least the professional class (which is, of course, not enough as most foreigners are not "professionals"). However, continued differentiation of who is an Amazing Perfect Special Outstanding Foreign Professional Demigod and who is a Big-Nose Trash Monkey "Professional", and continued battles to include all foreigners - including non-professional laborers - who want to put down roots in Taiwan still make me wonder.

Are we valued, Taiwan? Am I valued?

I don't know, and your message is more than a little muddled.
